Truck Accidents Can Present Complex Liability Issues
Truck accidents are more complicated than regular car crashes. Here are some of the biggest challenges in truck accident cases:
- Federal and state trucking rules: Truck drivers and trucking companies must follow strict safety laws, including limits on driving hours, vehicle weight restrictions, and maintenance requirements. If they break these rules, it can lead to serious accidents.
- Multiple liable parties: In a truck accident, fault may not just belong to the truck driver. The trucking company, the truck owner, the cargo loaders, or even a parts manufacturer could all be responsible.
- High insurance limits: Because trucks can cause major damage, trucking companies carry large insurance policies. While this means more compensation may be available, it also means insurers will fight harder to pay less.
- Rapid evidence disappearance: Trucking companies often have access to critical evidence, such as black box data and driver logs. If this evidence is lost or destroyed, it can make proving fault harder.
At John Foy & Associates, we know how to handle these challenges. We act fast to protect evidence, investigate all possible liable parties, and fight insurance companies that try to avoid paying fair settlements.
Our Truck Accident Attorneys in Greenwood Will Manage Your Case From Start to Finish
Truck accidents often leave victims facing challenges that can seem difficult to overcome. Our attorneys will take the lead in your case so you can focus on healing. We will:
- Investigate the crash: We collect key evidence, including police reports, black box data, and video footage. The trucking company controls many of these records, but we know how to obtain them before they disappear.
- Protect sensitive evidence: Trucking companies and insurers may try to hide or destroy evidence that proves their fault. We will act fast to send legal demands to preserve logbooks, maintenance records, and employment files that could be critical to your case.
- Access expert resources: Our team can work with accident reconstruction specialists, medical experts, and financial analysts to prove the extent of your injuries and losses.
- Assess your damages: Truck accidents often cause life-changing injuries. We make sure we account for every loss—financial and personal.
- Negotiate for a fair settlement: Trucking companies and insurers try to pay victims as little as possible for their accident-related injuries and losses. We will challenge settlement offers that are too low and demand full and fair compensation.
- Take your case to court if needed: If we cannot agree with the insurance company, we are ready to fight for you at trial.
Our Greenwood truck accident attorneys will handle everything, so you don’t have to worry. We aim to win your case and get you the maximum recovery possible, and you pay nothing unless we win. Contact us today for a free consultation.

- Pain, suffering, and emotional trauma (physical discomfort, post-traumatic stress disorder (PTSD), anxiety, and reduced quality of life)

- Compensation for a loved one’s death (funeral costs, loss of companionship, and financial support for surviving family members)

Who Is Liable for Damages in a Truck Accident in Greenwood?
Truck accident cases are more complicated than regular car accidents because multiple parties may be responsible. Liability could fall on:
- The truck driver: If they were speeding, distracted, impaired, or careless in any way, they may be responsible for the crash.
- The trucking company: Employers are often liable if their driver causes an accident while on the job. They may also be responsible for poor hiring or training practices.
- The truck manufacturer: If faulty brakes, tires, or other truck parts contributed to the accident, the manufacturer may be responsible.
- A cargo loading company: Improperly loaded or unbalanced cargo can lead to rollovers or jackknife accidents.
- A maintenance company: If a truck was not properly inspected or repaired, and that failure caused the accident, the maintenance provider may be liable.
Our team will determine who is responsible and build a case against all liable parties. We will also deal with insurance companies for each party on your behalf. This includes determining the percentage of fault they have in the crash.
Meeting South Carolina’s Filing Deadline for Truck Injury Cases
If you were injured in a truck accident, you have a set time to sue for damages. Generally, the state gives you three years from the date of the crash to file a lawsuit under S.C. Code Ann. § 15-3-530.
If you do not take legal action within this time, you may lose your right to seek compensation. For wrongful death lawsuits, where a loved one was fatally injured in a truck crash, the three-year deadline begins on the date of a loved one’s death, not the accident date.
Truck accident cases require strong evidence, and delays can make it harder to prove your claim. Insurance companies and trucking companies often try to stall investigations, hoping the deadline will pass.
We encourage you to contact John Foy & Associates now so we can file your case on time.
What to Do After a Truck Accident in Greenwood
Truck accidents are different from other types of traffic collisions. The size and weight of commercial trucks mean more serious injuries, larger insurance policies, and more complicated liability issues.
Taking the right steps after a crash can protect your health, future, and your right to financial recovery. Here’s what to do if you’ve been involved in a truck accident:
Call 911 Right Away
Truck accidents often cause severe injuries and major roadway damage. Call 911 to report the accident, even if you think it’s minor. Tell the dispatcher if anyone is hurt so emergency responders arrive quickly. A police report will also be important evidence for your case.
Get Medical Help—Even If You Feel OK
Truck crashes can cause hidden injuries, such as internal bleeding, whiplash, or traumatic brain injuries, which may not show symptoms right away. A doctor can document your condition, which protects your health and strengthens your injury claim.
Gather Evidence at the Scene
Since much of the key evidence is in the trucking companies’ control, you should document what you can. If you’re able, take:
- Photos and videos of vehicle damage, skid marks, road conditions, and traffic signs.
- Pictures of your injuries to show how serious they are.
- Contact details for witnesses who saw the crash. Their account of events can be critical later.
Do Not Speak with the Trucking Company’s Insurance Adjuster
Unlike car accidents, trucking companies have powerful insurance teams working to protect their bottom line. They may try to:
- Get you to admit fault or say you aren’t seriously injured.
- Offer a low settlement that won’t cover all your damages.
- Pressure you into signing away your rights.
Anything you say can be used against you. Instead of dealing with them yourself, let our attorneys handle all communication.
Get Legal Help Immediately
Trucking companies start their investigations right away—you should, too. We act fast to:
- Preserve black box data before it’s deleted.
- Demand driver logs and trucking company records that may show violations.
- Identify all liable parties to ensure we seek the highest compensation that covers your damages.
The sooner you call us, the more time we will have to work on your case. We don’t charge anything unless we win your case, so there’s no risk in reaching out.
