What Are Workers’ Compensation Benefits?
Workers’ compensation benefits are designed to provide financial and medical support to employees injured on the job. These benefits typically include:
- Medical Expenses: Coverage for doctor visits, hospital stays, medications, physical therapy, and surgeries.
- Lost Wages: Partial wage replacement if your injury prevents you from working temporarily.
- Permanent Disability Benefits: Compensation for injuries that result in long-term or permanent impairments.
- Rehabilitation Support: Help with returning to work or transitioning to a new role if your injury prevents you from performing your previous job.
Understanding these benefits is key to ensuring you receive the full compensation you’re entitled to. A Greenwood workers’ compensation attorney can help you through the process and maximize your claim.
Common Reasons for Workers’ Compensation Claim Denials
Unfortunately, not all workers’ compensation claims are approved. Some common reasons for claim denials include:
- Failure to Report the Injury on Time: Missing South Carolina’s 90-day reporting deadline can result in denial.
- Disputes About the Cause of Injury: Employers or insurers may argue the injury didn’t happen at work or wasn’t work-related.
- Insufficient Evidence: Lack of medical records or documentation can weaken your claim.
- Allegations of Misconduct: Claims may be denied if the employer alleges the injury was caused by unsafe or unauthorized activities.
If your claim is denied, don’t lose hope. Our workers’ comp lawyers in Greenwood can help you appeal the decision, gather additional evidence, and fight for the benefits you deserve.
Steps to Take After a Workplace Injury
If you’ve been injured on the job, acting quickly and carefully is essential. Here’s what you should do:
Report Your Injury Immediately
Notify your employer or supervisor as soon as possible. In South Carolina, you generally have 90 days to report your injury, but it’s best to do it right away to avoid complications.
Seek Medical Attention
Your health comes first. If it’s an emergency, go to the nearest hospital. For non-emergencies, your employer may require you to see a specific doctor under their workers’ compensation plan. Ensure your injuries are documented thoroughly, as these records will be critical for your claim.
File a Workers’ Compensation Claim
Your employer should provide you with the necessary paperwork to file a claim. Make sure the details are accurate and that you keep copies of everything you submit.
Document Everything
Keep records of your medical visits, expenses, missed workdays, and any communication with your employer or their insurance company. These details can strengthen your case if there’s a dispute.
Consult a Greenwood Workers’ Compensation Lawyer
The workers’ compensation process can be complicated, especially if your claim is denied or delayed. An experienced lawyer can handle the legal side of things while you focus on recovering.
