Dunwoody Uninsured Motorist Accident Lawyer

Every car owner in Georgia is supposed to have insurance, but as many as 12% of cars are on the road go without it. This means that if you are in an accident in Dunwoody, there’s approximately a 1 in 9 chance that there is no insurance to cover the cost.

Other accident victims find that the driver at fault had insurance, but only carried the minimum required coverage—which may not be enough.  Don’t get stuck with the bill. You need to talk to a Dunwoody uninsured accident lawyer.

How Much Money Can I Recover from an Uninsured Motorist in Dunwoody?

Georgia is a “fault state,” meaning that all auto accident victims are entitled to recover 100% of their costs from the driver who was at fault. It does not matter whether the driver had insurance. In the City of Dunwoody, you can recover all your costs even if the driver did not carry any insurance coverage at all. We often help people recover these types of costs and damages:

• Medical bills
• Prescriptions
• Physical therapy or other rehabilitation
• Repairing or replacing a car
• Lost wages, if you missed work time because of the accident

Some accident victims are entitled to additional, large damage awards. These are typically awarded for more severe losses such as a long-term disability or ongoing, severe pain. We know that money can’t undo the accident or return you to good health. But we also have seen the financial strain that an accident can cause, and the money you receive can relieve stress, pay the bills and help you plan for the future.

What Should I Do If I Am in an Accident With an Uninsured Driver in Dunwoody?

If you or anyone else needs emergency medical attention, call 911. If, however, your injuries do not seem that serious, we do have a few recommendations. By following these simple steps, you will protect your rights:

• Call the police, even if no one needs an ambulance. The other driver may try to talk you out of it, but don’t listen. Under Georgia law, you MUST report an accident involving injuries or a substantial amount of vehicle damage. By calling the police, you’re doing your legal duty.  And the police report will be essential to your claim.
• Keep calm, no matter what the other driver says or does. An uninsured driver may get upset, yelling at you or even blaming you for what happened. Remember that anything you say can be used against you. Do your best to be calm when talking to others at the scene, and don’t apologize or offer explanations.
• Take pictures or video with your cell phone camera. They say a picture is worth a thousand words, and we’ve found that’s true when it comes to accidents. Get photos and/or video of the accident scene, the damage to the vehicles, and your injuries.
• Talk to people at the scene. Bystanders or people who stopped to help may have seen the accident. Get their contact information.
• Go to the doctor, even if you don’t think you were really hurt. We talked to many people who thought their injuries were minor, but as the days and weeks passed, they got worse. Early treatment can be critical to a speedy recovery and it will help you present a strong claim.

One of the most important things you can do is to talk with a lawyer as soon as possible. Uninsured motorist claims are more complicated than ordinary insurance claims, and it is extremely difficult to navigate the legal system on your own.

How Can I Get Money If They don’t Have Insurance?

Some car accidents involve drivers who have no insurance at all, and many others are caused by drivers who don’t have enough insurance to cover the injuries and damage. This is because Georgia law only requires drivers to have a minimal amount of insurance coverage:

• $25,000 in bodily injury insurance (per victim)
• $50,000 in bodily injury insurance (total)
• $25,000 in property insurance

When you consider the cost of vehicles and health care, it’s easy to see how a moderately serious accident can cause damage far beyond the minimum insurance coverage. The local courts frequently see cases where there is no insurance, or not enough insurance. Lawyers and judges can use several ways to get a financial recovery for victims:

• Through the uninsured or underinsured motorist protection coverage in your own insurance policy
• Through other insurance policies that will cover your injuries
• Through a court order requiring the other driver to pay you out of his or her own pocket
• By placing a lien on the uninsured driver’s assets

Collecting money from an uninsured driver can be a complex process, but an attorney can handle it without putting additional stress on you.  At John Foy & Associates, our mission is always to get you a full financial recovery—no matter what it takes.
