Insurance companies created uninsured motorist insurance to protect drivers from the financial consequences of being hit by a driver without insurance. When such a driver hits you, the policy is supposed to kick in and provide you with the financial resources you need to repair your vehicle and pay off your medical bills.
It does not always work out this way. A Dacula uninsured motorist accident lawyer at John Foy & Associates can help you ensure that you do get the money you are rightfully owed.
Our Dacula car accident lawyer can review what happened and explain your possible next steps.
What Happens When Drivers do Not Have Insurance?
When a driver does not have insurance, it does not prevent them from driving. They may use the roads regularly and never cause any problems. Unfortunately, many uninsured drivers get involved in car wrecks where they are the ones who are at fault.
Because they have no liability coverage in place, the victims of the accident are left to pay their medical bills independently. If an uninsured driver has hit you, hopefully, you have uninsured motorist insurance in place to protect you. If not, the entire cost of repairs and medical treatment may fall on you rather than the negligent motorist.
People with collision or comprehensive insurance can sometimes use those policies to recover compensation for some or all of their damages.
Uninsured Motorist Insurance and How It Works
Through an uninsured motorist insurance policy, you receive coverage that will take financial responsibility for any damages caused to you by an uninsured driver. If you take financial losses after being hit by an uninsured driver, the plan will pay you an amount equivalent to your losses.
In the best-case scenario, you would collect from the negligent driver’s insurance policy. You need to rely on your policy to get compensation when they do not have any.
The person who provided the uninsured motorist policy does not intend to give you the full value of your claim. Instead, they may even attempt to persuade you that you were the one who was at fault in the accident. If they can do so successfully, they may get out of paying you anything at all. In fact, drivers who are found to be at fault would end up being liable for the other driver’s expenses as well as their own.
How Much Compensation Can You Get?
Assuming that you were not at fault, your uninsured motorist insurance policy pays any damages up to the limits featured in the contract. You need to understand the coverage limits stated in the policy, as people rarely recover more money than what is described in their contracts.
Even if you do manage to get the maximum amount from your uninsured motorist insurance policy, your total damages may still not be paid. In other cases, your total damages are technically covered, but the insurance company does not want to pay. At this point, you need an uninsured motorist accident lawyer in Dacula to work the case.

You Need Help with Your Claim
Insurance is not as simple as you think. The insurers often attempt to lower their expenses by providing their customers with much smaller settlements than they deserve. This is very likely to happen when you attempt to make a claim with your uninsured motorist insurance policy.
Instead of the insurance company offering you the total amount of your damages, the adjusters will probably attempt to diminish the severity of your injuries and question your total property damages. Having a Dacula uninsured motorist accident attorney advocate for you at this point is ideal. With a lawyer on your side, you have someone capable of negotiating effectively with the insurance adjusters.
On your own, they may be able to get the upper hand due to your lack of knowledge and expertise. Do not let them put their profits above your needs. Get help from an uninsured motorist accident attorney at John Foy & Associates to ensure that you get a settlement that reflects the totality of your actual losses.
Georgia Requires Insurance
In Georgia, drivers must have a minimum volume of liability coverage for their vehicles. If they choose not to purchase such coverage, they may be subject to penalties, such as fines. Regardless, countless people still choose to drive without carrying appropriate coverage.
For your reference, the insurance requirements in Georgia are:
- $25,000 for any single person’s injuries per accident
- $50,000 for the total of all injuries per accident
- $25,000 for total damaged property per accident
When a person decides to drive without insurance, they are being disobedient to the law. This is bad enough, but even worse is the fact that there is no safety net in place for the victims of accidents that they cause. If an accident does happen, anyone who does not have an uninsured motorist policy will be left liable for their own costs.
