What Happens If You Are a Passenger in an Uber Crash?
Any accident scene can mean chaos and confusion, but if you are a passenger in an Uber that is involved in an accident, it can cause additional frustrations and challenges at the scene of the crash.
As a passenger of an Uber that crashes you have rights under the law and what happens at the scene can have implications on your case and your ability to recover for any losses that you may sustain. Always call law enforcement and an ambulance for assistance when you are in an Uber accident.
If the Uber Driver Is to Blame for the Crash
When the Uber driver is at fault for an accident, they are liable for the injuries they cause to their passengers as well as others that may be part of the accident, such as occupants in other vehicles, pedestrians, bicyclists, or other innocent bystanders. In these instances, Uber insurance coverage may be available to the victims. Coverage availability will depend on whether the Uber driver was using the application at the time of the crash.
If Another Driver Is at Fault for the Accident with the Uber
When another driver is to blame for the accident, and you are the passenger in an Uber vehicle, you may have multiple avenues for recovery. While your primary approach for compensation would likely be through the at-fault driver’s insurance, Uber coverage may still be available as third-party liability coverage for any losses that remain.
If There Is a Dispute as to Who Is at Fault for the Uber Accident
The determination of fault for an accident is not always clear or agreed upon by all parties to a case.
