Augusta Uber Accident Lawyer

Uber accidents are one of the most rising personal injury accidents. Victims of these accidents are entitled to seek compensation for any injuries that an Uber driver’s actions have caused.

Not all Uber accidents are covered through the company’s liability insurance.

The Uber driver’s actions and login activity are just some factors that determine Uber’s liability in an accident. To discover whether you have an attainable Uber accident lawsuit, you should consult with an experienced Augusta rideshare accident lawyer from John Foy & Associates.

How Uber Can Be Held Liable for an Uber Accident

Every company that relies on the services of a third party is responsible for the third party’s actions, and Uber is no exception. Even though Uber drivers are classified as independent contractors, Uber is still responsible for their drivers’ actions through vicarious liability.

Vicarious liability is a legal concept that holds both the third party and the company associated with the third party legally responsible for their unlawful behavior. Through vicarious liability, a company responsible for a third party must exercise a certain amount of control if the third party is acting recklessly. Companies that fail to exercise that control can be held liable for the third party’s actions.

How an Uber Driver Can Be Held Liable for an Uber Accident

Two factors determine whether an Uber driver can be considered the negligent party of an Uber accident; the driver’s login activity and the driver’s actions.

An Uber driver that was not logged in during an Uber accident can not rely on Uber’s liability insurance to cover their accident. An Uber driver who was in the middle of picking a passenger up or was in the middle of dropping a passenger off can be covered through Uber’s liability insurance.

How an Uber Driver’s Reckless Actions Cause an Uber Accident

When it is discovered that an Uber driver’s actions contributed to an Uber accident, the Uber driver’s auto insurance will have to cover the damages of your accident. Even though Uber drivers must practice caution while driving, they can still engage in reckless behaviors while logged in. Some of the common reckless actions that lead to Uber accidents include:

• Aggressive driving. Uber drivers may engage in aggressive driving like tailgating and cutting other drivers off to complete their trips.
• Distracted driving. Uber drivers travel for long periods and are prone to becoming more distracted the longer they travel.
• Drowsy driving. The long travel periods on the road can cause Uber drivers to become fatigued easily. Even relying on caffeinated or energy drinks will not help Uber drivers stay awake behind the wheel.
• Intoxicated driving. It is hard to determine which state an Uber driver is in when they log in to begin driving. Uber drivers could have consumed alcohol before getting on the road or consumed an illegal substance before accepting some ride requests.

How Long Will an Uber Accident Claim Take to Settle?

An experienced Uber accident lawyer can better understand how long it will take to resolve your Uber accident claim. Every Uber accident lawsuit is unique. Some of the factors that play a major role in the length of an Uber accident claim include:

• The number of negligent parties. The more parties involved in your Uber accident, the longer it will take to seek a resolution to your claim.
• The ability to come to a mutual agreement. During your claim, there will be a point where you will have the opportunity to come to a mutual decision with all negligent parties. Your Uber accident lawyer may have to negotiate with multiple insurance companies to make a fair decision.
• The nature of your injuries. Your injuries play a vital role in the amount of compensation you are allowed to pursue. If your injuries are permanent and there is little to no chance of recovery, the amount of compensation awarded will be greater.
• The negligent party’s actions during the accident. If you decide to file a lawsuit against your Uber driver, the Uber driver’s login activity will play a pivotal role in determining liability for the other parties.
