What to Do After a Taxicab Accident in Marietta
There are two actions you should always take after an accident:
- Get any necessary emergency medical attention.
- Report the accident to the police.
Get Medical Attention
Your well-being is the number one priority. Check on yourself and others in the accident. If someone has severe or life-threatening injuries, call 911.
Sometimes, accident injuries take time to show up. No matter how you feel, see a doctor who can check you for injuries. If you experience worsening pain, see your doctor for follow-ups.
Waiting too long to get medical treatment will hurt your case. The at-fault driver’s insurance company will doubt your injuries. They will use your lack of treatment as an excuse to pay you less. So, always see a doctor.
Report the Accident
After addressing medical needs, call the police. Or, make sure the taxicab driver calls the police. You should report any accident with injuries, deaths, or at least $500 in property damage (Georgia Code Section 40-6-273).
Police should create an accident report. The report might include details about the accident scene. You or your lawyer can request a copy of this record for your case.
Besides getting medical attention and reporting the accident, here are some other things you should do.
Get Information About the Taxicab Driver
You’ll need to gather facts about the cab driver in your accident. If you were a taxicab passenger, ask for the following:
- The taxi driver’s name
- The taxicab company that employs the driver
- The driver’s license number
- Contact information for the taxi company and driver
If you were another driver in the accident, exchange the above information. Also, get the driver’s insurance policy number.
Take Pictures at the Scene
Use your phone to snap pictures of:
- Any visible injuries you have
- The vehicle damage
- The entire accident scene
- Anything else that helps show what happened.
Pictures from the scene help preserve what occurred. Photographic evidence will support your injury claim.
Look for Witnesses
Other people might have seen your taxi accident happen. Talk to any potential witnesses. Ask what they saw, and get their names and contact information.
Your Marietta taxicab accident lawyer will reach out to witnesses later. Witness statements can be incredibly helpful for your case.
Schedule a Consultation with a Lawyer
As soon as possible, set up a meeting with an experienced taxicab accident lawyer. A lawyer can make sure you are on the right track. They can help you investigate the accident and ensure you’re gathering the best evidence.
Your lawyer will also determine who was at fault for the crash. Identifying the responsible party is not always easy. However, it’s information you will need to file a personal injury claim.
How You Can Get Paid After a Marietta Taxi Accident
In Georgia, the at-fault party in an auto accident is legally liable for the costs. The driver who caused your taxicab accident should pay for your personal injury damages like:
- Medical bills
- Lost wages
- Vehicle repair costs
- Pain and suffering
Consider your role in the accident. Were you a taxicab passenger or another driver? What do you remember right before and during the accident? Did you witness careless behavior from the taxi driver?
You’ll need to discuss all questions with your lawyer. Most drivers are (and should be) covered by auto insurance. When a driver causes an accident, their insurance company is responsible for the costs.
Seeking Compensation from the Insurance Company
You will have costs after your accident. To recover those costs, you’ll need to file a personal injury claim with the insurance company. The claim should outline:
- How the at-fault driver caused your accident
- All of the damages you are claiming for compensation
Taxicab accident claims can be more complicated than other cases. It depends on the driver’s employment status. You’ll need to know if the driver is employed or an independent contractor.
If the taxicab company employs the driver, the company’s insurance likely applies. You will file your claim with the company’s insurer. However, some taxi drivers are responsible for their insurance. In this case, you’ll submit your claim with the driver’s insurance.
What if the at-fault driver was not the taxi driver?
If another driver caused the crash, you’ll turn to that driver’s insurance company. As you can see, insurance matters can quickly become complicated. The complexity is just another reason to consult with a taxicab accident lawyer.
