Accidents Caused by Defective Manufacturing
Some accidents happen because of faulty vehicle manufacturing. A manufacturing defect often affects only one product. It could happen at:
- A manufacturing plant
- A dealership or supply store
- A shipping location
An error in manufacturing can cause a severe or deadly accident. If so, you will need to gather evidence that the mistake led to your crash. An experienced lawyer can help you investigate where the problem began.
Accidents Caused by Poor Design
An accident can also occur because of defective vehicle designs. A design defect often affects a whole line of products.
If a manufacturer discovers a design defect, the company should alert consumers. For example, owners of the affected car or car parts should receive a notice. The manufacturer could be liable for accidents that result from design defects.
Determining Fault in a Defective Design or Manufacturing Accident
After an accident, you’ll need to investigate all possible at-fault parties. Manufacturing defects are often complicated. You’ll likely need help uncovering the cause of the problem.
The responsible party for the accident could be:
The Vehicle Manufacturer
Manufacturing companies are often at fault for a defective vehicle. The defects could have happened at any point during the manufacturing process.
Vehicle manufacturers are often large companies. They will have legal teams to help them with claims. It’s best to obtain a lawyer as soon as possible to protect yourself.
The Parts Manufacturer
Some accidents happen because of a faulty part. Defective vehicle components can include:
- Wheels
- Tires
- Steering wheels
- Batteries
- Fuel systems
- Brakes
- Electrical systems
- Gas tanks
- Seatbelts
Some defects might fail to protect you during an accident. For example, a faulty airbag could worsen injuries or cause death during a crash. The manufacturer could be responsible for the damages that the part would have prevented.
Other defects can increase the risk of an accident. For example, a faulty vehicle might be more prone to rollover accidents.
It can be challenging to identify the defective part. Work with a car accident lawyer who can help you investigate.
A Shipping Company
Companies that ship or distribute parts might be partly responsible. The company might have known about the defects when they sent out the products.
A Supply Shop or Dealership
The person or company that sold the vehicle or its components could be partly responsible. Again, the company could have sold a car that it knew wasn’t safe to use.
Several parties might be liable for the damages from your accident. Talk to a Stonecrest car accident lawyer today about your options. At John Foy & Associates, we can help you during a FREE consultation.

What to Do If a Defective Vehicle or Part Caused Your Accident
If you were injured because of a car defect, you must preserve the evidence. You could have a product liability claim under the Official Code of Georgia Annotated (OCGA) §51-1-11. However, you will need to back up your claim to increase your chances of recovery.
Here are some actions to take after your accident:
- Report your accident to the police right away.
- Take pictures of the accident scene.
- Photograph your injuries and vehicle damage.
- Don’t have any car repairs done without talking to a lawyer first.
- Don’t admit blame for the accident to anyone.
If you can, keep the vehicle in a safe location. If it goes to an impound lot, try to keep track of its location. Contact a lawyer immediately who can advise you on the best actions. They can inspect the car and investigate the defect details.
Building a claim for a vehicle defect is challenging. You will need help from an experienced car accident lawyer as soon as possible. Call a trusted lawyer who can help you with all of the above and more.
Negotiating a Fair Accident Settlement
Manufacturers often have powerful legal teams. They also carry large insurance policies in case of injury accidents. If you become injured because of a defect, be prepared to fight for the compensation you deserve.
Insurance companies will use many tactics to reduce what they have to pay you, such as:
- Offering a lowball settlement
- Downplaying your injuries
- Blaming you for the accident
- Questioning your total damages
You might get a settlement offer soon after your accident. However, the amount will probably be a lowball. It won’t come close to covering what you’ve lost.
You have a right to send a counteroffer. A Stonecrest car accident lawyer can help determine what settlement you deserve. They’ll know how to counteroffer and negotiate with the insurance company.
Class-Action Lawsuits for Vehicle Defects
Some defective vehicle parts lead to class-action lawsuits. A class-action suit can come from multiple people who were injured by a defect. One plaintiff represents the other parties.
If a defect caused your accident, other people could have suffered in the same way. Talk to your lawyer about any possible class-action cases regarding the defect. You might have the chance to join a lawsuit.
