The truth is, there is no average FedEx truck accident settlement you can rely on to give you an accurate idea of how much you could be awarded if your case was successful. While there are thousands of search results online that suggest a specific dollar amount as the average FedEx truck accident settlement, these figures are largely inaccurate.
To determine the average FedEx truck accident settlement, you would need to add up all the FedEx truck accident settlements and divide them by the total number of awards. There are too many elements that can skew the results, such as the number of settlements, how many years of settlements should be included, the success and failure rates of individual personal injury law firms, and the highest and lowest settlement amounts. Working with a knowledgeable Atlanta FedEx truck accident lawyer from John Foy & Associates is the best way to gain insight into what your personal FedEx truck accident case is worth.
Why Average Settlement Amounts Are Inconclusive
This is the problem with average settlement amounts: they are misleading. When you find another law firm giving exact average settlement amounts, you have to wonder where they got their information. Are they evaluating the settlement amounts of their own clients?
Is the law firm calculating the average settlement amounts for injury victims and claims filed in their state or across the country? Where did they obtain the information to come up with this settlement figure? There is no way of knowing where these numbers came from unless explicitly stated on the webpage.
That is because average FedEx truck accident settlement amounts are generally inconclusive. Not only are the numbers skewed by considerably higher and lower payouts, but these numbers in no way indicate how much an injury victim could expect to recover for their damages. This is troubling at best since searching for FedEx truck accident settlements is often sought after so those suffering can get a better idea of what they could win.
How to Determine the Value of Your FedEx Truck Accident Settlement
We understand how frustrating it can be to want answers but be unable to find them. For this reason, your Atlanta personal injury attorney at John Foy & Associates is standing by, ready to take a closer look at the specific damages you have and give you insight into what your losses could be worth. Here is a general idea of how we will determine the value of your FedEx truck accident claim:
Review Your Economic Damages
First, we need to carefully evaluate your economic damages. These refer to all monetary and out-of-pocket expenses related to your FedEx truck accident and the injuries you sustained. Not only should you be reimbursed for the damage to your vehicle, but the liable party should compensate you for the diminished value of your car, any rental car costs, the cost of purchasing a new vehicle if yours is totaled, and additional compensation for your auto insurance premium increases.
You should also be compensated for your lost wages. The time you took off work could dramatically impact your ability to support your family. As part of your FedEx settlement, you can demand reimbursement for not only your lost wages but also your reduced earning potential, loss of paid time off or sick leave, loss of health insurance coverage, and even the retirement savings your employer contributed.
Account for All Non-Economic Damages
Next, we need to review your non-economic damages. Under Georgia Code §51-13-1, though non-economic damages are intangible, they are recognized as particularly impactful and, in some cases, more challenging to cope with than economic losses. For this reason, they should be included in your settlement accordingly.
Non-economic damages describe every loss that is not money-related. When you are dealing with anxiety related to driving, experiencing post-traumatic stress disorder (PTSD), or having trouble coping with disfigurement or permanent skin scarring, these types of losses are unique and should be evaluated individually. Your Atlanta catastrophic injury attorney will ensure every non-economic loss is accounted for so we can determine how much your FedEx truck accident lawsuit is worth.
Be Prepared to Challenge Partial Fault Accusations
Partial-fault allegations are common in most types of personal injury claims. This is, in part, because Georgia is a modified comparative negligence state. This means that under OCGA §51-12-33 if you share liability for the accident, you will not receive the total value of your FedEx truck accident settlement.
Instead, your portion of the fault will be taken out of your settlement. For instance, if you changed lanes without signaling immediately prior to being hit by a distracted driver, the judge might find you 30% responsible for your injuries. In this case, you could only expect to receive 70% of your FedEx truck accident damages.
Never Depend on Punitive Damages
Punitive damages have a reputation for being frivolous and greatly increasing the value of injury victim settlements. However, punitive losses are generally only awarded when the defendant’s conduct is punishable under Georgia Code §51-12-5.1. The judge may award punitive damages if they find the defendant’s actions reprehensible, egregious, or grossly negligent.
