Possible Causes of a U-Haul Truck Accident

U-Haul rentals come with several risks. Most people who drive U-Haul trucks are regular drivers, not professionals. This puts a lot of people who are driving large trucks on the road without added experience.

Besides inexperience, other causes of U-Haul accidents include:

• Poorly-loaded items
• Improper truck maintenance
• Distracted driving
• Drunk driving
• Speeding
• Failure to yield
• Faulty truck equipment

Renters are often fatigued and overwhelmed already. Moving is a tiring and long process. If a driver doesn’t get enough rest, they can be dangerous behind the wheel. A renter might make careless driving decisions or drive aggressively.

If truck equipment fails, the renter is probably not at fault. U-Haul or a company that’s worked on the truck might be liable for the damages. Plus, longer routes can increase the risk of things breaking down or having issues.

U-Haul Truck Accident Damages

After a U-Haul accident, you will probably have damages. Personal injury damages are any costs resulting from your physical injuries. Examples of damages include:

• Doctor and hospital bills
• Prescription medications
• Physical therapy or rehabilitation
• Lost wages
• Loss of earning capacity
• Vehicle repair costs
• Pain and suffering
• Loss of enjoyment of life
• Scarring or disfigurement

Every accident is different. Your total damages will depend on your injuries and how the accident has impacted you. It also depends on your economic versus non-economic damages:

• Economic damages, such as medical costs, have set dollar amounts. You can prove these damages through documentation in your injury claim.
• Non-economic damages, such as pain and suffering, do not have set values. You don’t have to prove these damages through bills or receipts. However, your lawyer will need to determine what these damages are worth in your claim.

After your accident, you’ll need to know the full value of your damages. If you were not at fault, you can file an insurance claim against the responsible party. (This is usually another driver or U-Haul.) Your claim will need to outline your damages and the compensation you’re seeking.

Determining Fault in a U-Haul Accident

U-Haul accidents are complicated from a legal standpoint. When someone rents a U-Haul truck, they sign waivers that basically protect the company from liability. Renters can either purchase insurance or plan to use their own insurance company.

If a U-Haul renter causes an accident, liability is complicated. You will need to determine which insurance covers the accident. It could be insurance through U-Haul, the renter’s auto insurance, or a combination. If a third-party is at fault, their insurance would be responsible for the costs.

If you cannot get a settlement from an insurance company, you might need to go to court. Your lawyer can examine the details and help you make the best decision. If you decide to sue, your lawyer can help you with each step.

Common Injuries from U-Haul Truck Accidents

U-Haul trucks are large. If someone is moving a lot of items, the truck can become very heavy. Plus, a truck can become unstable if someone loads it incorrectly. All of these factors can lead to serious injuries during an accident.

A heavy or unstable truck can cause the driver to lose control. If items fall from the truck, they can fall on victims or cause a dangerous roadblock. No matter the details, painful and costly injuries are common in these accidents.

Injuries from U-Haul accidents can include:

• Neck and shoulder injuries
• Severe cuts or bruises
• Traumatic brain injuries (TBI)
• Broken bones
• Spinal cord injuries
• Organ damage
• Seat belt injuries

Some injuries are incredibly serious. Victims can become paralyzed or disabled in many ways. Disabilities can prevent victims from working as they could before. If the injuries are life-threatening, they can lead to death or serious trauma.

Don’t discount the severity of your injuries after a U-Haul accident. Even if you feel alright, see a doctor who can physically exam you. Many times, a victim does not realize the full extent of their injuries until hours or days later.

What to Do After the Accident

After the collision, here are steps you can take to start building your claim:

• Take pictures of your injuries and any vehicle damage.
• Call a Roswell U-Haul truck accident lawyer.
• Keep track of your accident damages by saving medical bills and other documents.
• See a doctor as soon as possible and go to all follow-up appointments.

Also, be careful when talking about the accident. Avoid discussing any details unless speaking to your lawyer. Otherwise, the insurance companies might use something you’ve said against you.
