Motorcycle Accident Claim Deadlines in Roswell
Pursuing legal action after a motorcycle accident may not be one of your top concerns. After all, when you are still struggling to cope with the physical fallout, emotional trauma, and financial distress associated with a motorcycle accident, bringing your case to court and dealing with the insurance company may be the last thing you want to deal with.
However, it is important to get started on your Roswell motorcycle accident claim as soon as possible. This is because Georgia law requires motorcycle accident and personal injury claims to be filed before the two-year statute of limitations expires under O.C.G.A §9-3-33. Generally, claims must be filed before this two-year period ends.
However, the exact date that your claim must be filed before the statute of limitations runs out can vary widely depending on when your accident occurred, the date you were diagnosed with your injuries, and other factors.
If your motorcycle accident claim is not filed before this deadline passes and you attempt to pursue your claim at a later date, the judge will have no other choice but to dismiss your case with prejudice.
You can avoid the statute of limitations having an adverse impact on your case by getting an experienced motorcycle accident attorney in Roswell on your side soon after your accident as opposed to waiting until you are feeling up to the challenge.
Potentially Liable Parties in a Motorcycle Accident Claim
Establishing fault is one of the top responsibilities your motorcycle accident lawyer in Roswell will have. The individual or entity who is responsible for causing your motorcycle accident should also be responsible for covering your costs in full.
There are many parties who can share liability for Roswell motorcycle accidents. In many cases, negligent driving plays a part in these collisions. Some of the more common types of negligent driving include:
- Impaired driving
- Speeding
- Following too closely
- Failure to stop
- Failure to use a turn signal
- Failure to yield to the right of way
- Distracted driving
- Drowsy driving
- Road rage
However, reckless drivers are not the only cause of motorcycle accidents in Roswell. In fact, there are many other factors that have been known to cause motorcycle collisions. In some instances, roads are too dangerous. This may be because of large potholes, unsecured road construction zones, missing street lights or signs, or other hazards. When this happens, the government agency responsible for road safety and maintenance could be held accountable.
We’re ready to identify liable parties on your behalf, including motorists, negligent motorcyclists, and manufacturers.
Suing a Manufacturer
Motorcycle accidents in Roswell are also often caused by auto part malfunctions. Whether the vehicle that hit you was defective or a part on your bike malfunctioned, parts designers, manufacturers, and distributors can all be held accountable. Additionally, safety inspectors, auto dealerships, and other third parties could also share fault.
To find out who is at fault for your Roswell motorcycle accident injuries, your attorney will need to carefully examine the details of your case. The evidence we obtain will prove based on a preponderance of the evidence that the defendant in your case is culpable for your injuries.
How to File Your Motorcycle Accident Insurance Claim in Roswell
Filing a motorcycle accident claim is one of the most tiresome but necessary parts of the motorcycle accident claims process. Georgia follows a fault-based system for motor vehicle accidents. When you are involved in a collision, you will file a claim with the liable party’s insurance provider.
However, dealing with the insurance company is no easy feat. Insurance companies are for-profit, and they will lose money by paying out on your claim. You can expect them to utilize the biker stigma to place unwarranted fault on you, make you an insultingly low offer in an attempt to avoid maximum payout, and find other tactics to take advantage of you during this difficult time in your life.
You can avoid being made a victim twice by having your Roswell motorcycle accident attorney step in and deal with the insurance company for you. This is an excellent way to show the insurance company that you mean business and will not settle for less than you deserve.

Calculating the Value of Your Roswell Motorcycle Accident Claim
You have the right to be made whole when someone else is responsible for causing your motorcycle accident damages. This means you can be compensated for more than just financial losses. Financial losses are also commonly referred to as economic damages, which are easier to prove due to their financial trail.
However, you may be surprised to learn that you can recover compensation for non-economic damages which do not have a monetary value. Some of the more common types of losses awarded in Roswell motorcycle accident claims include:
- Emotional distress
- Pain and suffering
- Diminished quality of life
- Loss of consortium
- Lost wages
- Loss of potential future earnings
- Property damage
- Medical expenses and equipment
