How Can a Pedestrian Accident Attorney in Roswell Help You?
Depending on the situation, insurance adjusters might even openly deny your claim. You contrast any potential faults you may have with the fault of the automobile or truck driver. Most of the time, you won’t get compensated for your wrongdoing.
It is essential to have an experienced attorney on your side due to the complexity and differences in each case. You can get help from a pedestrian attorney in a number of ways, such as:
- Taking care of all legal issues in your case and allowing you to focus on your recovery
- Determining who is at fault and the extent of each person’s responsibility
- Handling the discussions and negotiations with the insurance adjusters
- Discussing possible settlement with the opposing side
- A personal injury lawyer will prepare your case for trial if settlement negotiations are not the best option
- Gathering all pertinent information to prepare your case for trial
A lawyer’s responsibilities go beyond those listed above. This is a rough outline of what they can do to assist with the claim filing process and secure the settlement you seek. After an accident, you shouldn’t have to worry about managing the legal process on top of everything else.
Steps to Take After a Pedestrian Accident
Those who have been hurt in a pedestrian collision should dial 911 right away and remain there until law enforcement and rescue workers arrive. It is crucial to precisely document the occurrence as soon as possible because the other parties involved in it have a vested interest in shifting blame away from themselves. The injured party should obtain the names and contact details of any witnesses.
Additionally, it’s imperative to hold off on speaking publicly about the accident’s details until you’ve met with an experienced attorney. You should take as many pictures of the entire region as you can from various angles.
Document Everything
If you decide to seek medical attention, keep thorough records of all procedures, examinations, and costs. When requesting damages in a personal injury claim, this will be beneficial. It is more difficult for the opposing party to dispute these claims the more documentation you have to support the costs you incurred as a result of the injury.
After being involved in a pedestrian accident, it is in your best interest to contact a pedestrian accident lawyer in Roswell. An attorney who focuses on pedestrian accidents can assist you in locating potential sources of recoupable damages and in gathering evidence, such as medical records and deposition testimony, for use in settlement talks or a courtroom trial. An attorney for pedestrian accidents may be able to negotiate a settlement with the party at fault or launch a lawsuit.
Proving Liability After a Pedestrian Accident
There might be conflicting opinions about who is to blame. The driver can challenge a pedestrian’s right of way, claiming that the victim jaywalked, crossed against the light, or ran into the road. It is essential to check out the driver and not always believe what they say.
The driver may have run a light, been on their phone, or not seen the pedestrian crosswalk sign. It may be important to visit the scene to gather pictures, consult with witnesses, and retain accident reconstruction specialists in order to prove liability. Finding out the extent of the injury and the numerous accident reasons can also be helped by chatting with witnesses, experts, doctors, and other professionals.
Modified Comparative Fault
The law of negligence usually establishes who is liable. However, both the driver and the pedestrian may be at fault. If so, Georgia’s modified comparative fault laws do not prevent you, the pedestrian, from receiving compensation; however, it can reduce the amount you receive.
Most of the time, an injured pedestrian can make a claim with their insurance carrier and seek compensation from the driver’s or vehicle owner’s motor liability insurance. Almost all states mandate that drivers and vehicle owners have liability insurance to protect them against third-party personal injury and property damage. Who caused the accident and the details of the insurance policy affect how much money is recovered.

Common Causes of Pedestrian Accidents
According to Georgia law, drivers must give way to pedestrians. One of the most crucial things when taking to the road is that pedestrians (unless they are acting recklessly or negligently) should be given the right of way. However, many drivers forget this, which frequently leads to accidents.
There are several reasons why accidents involving pedestrians happen, including the following:
- Driving under the influence of drugs
- Driving while intoxicated
- Driving when inattentive, like using a phone
- Exhausted driving
- Disregarding posted speed limits and traffic signals
- Not yielding or stopping at a crosswalk
Although there are numerous more causes of pedestrian accidents, these are the ones that are most frequently recorded in Georgia. When a pedestrian is struck by a car, the driver typically places the blame on the pedestrian. On the other hand, pedestrians typically have the right of way in collisions, and as long as they abide by the laws, they are eligible for damages.
