How a Roswell Uber Accident Attorney Can Help

An Uber accident lawyer can help you file an accident claim against all appropriate parties. They can guide you through every step of the process and explain how to hold each party accountable. An experienced lawyer knows how to collaborate with their client to present the best case possible.

Uber accident lawyers in Roswell assist Uber accident victims in filing a claim against either the Uber driver, the other driver involved in the accident, or the company itself. This is one of the aspects of an Uber accident that confuse many accident victims. An Uber accident lawyer knows how to establish the liability of each party and can suggest the different types of compensation that you should seek from all parties.

How Liability for an Uber Accident Is Determined

Even though Uber is required to carry its liability insurance for drivers, the company also requires its drivers to carry their insurance while driving. This confuses many accident victims because they are unsure who to file their lawsuits against.

As an accident victim, you can hold both the Uber driver and Uber accountable for your injuries based on certain criteria. The log-in activity of the Uber driver determines how much of Uber’s liability insurance will cover the driver’s accident. The following scenarios are some of the most common scenarios that help determine Uber’s liability in an accident:

• Period 0 – This is when the driver is logged in and waiting for a ride request.
• Period 1 – This is the period where the driver has accepted a ride request and is in the process of picking a passenger up.
• Period 2 – This is the period when the driver has picked the passenger up and is dropping the passenger off at their destination.

Uber’s Liability in Each Log-in Period

During Period 0, Uber is not liable for any accident, and the Uber driver’s auto insurance company will have to cover the damages. An accident during Period 1 and Period 2 will be covered through Uber’s liability insurance. The additional factors of the accident will determine whether Uber will provide coverage of up to $1 million for damages or provide additional coverage like uninsured motorist coverage.

Compensation for Your Uber Accident

You are entitled to pursue various forms of compensation from all parties involved in your accident, including the following:

• Medical expenses. Any medical expenses you have to pay that are a direct result of your accident can qualify as damages. This includes any medications, physical therapy, or medical devices you have to pay out of pocket.
• Lost income. Any days that you had to take off of work due to your accident can also qualify as compensation in your claim. An experienced Uber accident lawyer can calculate the amount of income you have missed out on due to your accident.
• Pain and suffering. Any mental or physical anguish caused by the accident can also be considered a type of damage.

Can Uber Retaliate Against You for Filing a Claim Against the Company?

Uber does not have the right to ban you from using their services regardless of the outcome of your claim. As an accident victim, you have the right to hold the company liable for its role in your injuries. Your right to pursue legal action against the company does not violate the company’s guidelines. Under certain circumstances, you may be able to file another claim against the company if the company tries to retaliate against you for taking legal action.
