Common Liability Issues in Accidents Involving Rideshare Drivers
Accidents involving rideshare companies like Uber can be confusing, especially when it comes to insurance. Uber provides various types of coverage depending on the stage of the trip the driver was in when the collision occurred.
Here’s how it works:
Stages of an Uber Ride
Understanding what stage the Uber ride was in during the accident is very important. Uber’s insurance coverage changes depending on whether the driver was waiting for a ride, on the way to pick someone up, or already driving passengers.
Knowing these stages helps you figure out which insurance policy should pay for your damages.
- When the app is off: The driver’s private auto insurance handles the costs.
- When the app is on but no ride is accepted: Uber provides limited coverage.
- When a ride is active: Uber’s full $1 million insurance policy applies.
Who Might Be Liable
After a rideshare accident, figuring out who is responsible for the crash can be tricky. Sometimes, it’s the Uber driver, but other times, it could be someone else.
Below are some of the most common people or groups who might be held responsible for paying damages after an Uber accident:
- The Uber driver
- Another motorist or road user (e.g., a motorcyclist, a bicyclist, etc.) involved in the crash
- The rideshare company itself
- Vehicle makers (if a faulty car part caused the crash)
- Government agencies
A car accident lawyers in Milton from our team will sort through all the details and figure out who is responsible. We talk to the insurance companies for you and work to get you every dollar you deserve. Call us today for a free case evaluation and review your legal options with our team.
Who Can Be Hurt in an Uber Accident?
Uber accidents can involve multiple people, which, in many cases, makes a case for damages more challenging. You might be:
- A passenger: Riding in the Uber when the accident happened
- A driver: Either driving the Uber or driving your car when hit by a rideshare vehicle
- A pedestrian or bicyclist: Hit by an Uber on the road
No matter how you were hurt, you have rights. The team at John Foy & Associates is ready to guide you through the legal process and help you recover damages for what you’ve lost.
