Individuals who have been injured in a LaGrange Lyft accident that was caused by a driver’s negligence can seek compensation for their injury through Georgia’s personal injury claims process.
This type of accident can be complex, due to the insurance resources involved in Lyft accidents. An experienced LaGrange rideshare accident lawyer from John Foy & Associates can help you with your claim.
Potential Sources of Liability in a LaGrange Lyft Accident
While there are occasionally other sources of liability, most accidents involving a Lyft vehicle are the result of a driver’s negligence. This can include:
- The Lyft driver who caused an accident that resulted in injuries to their passenger, the occupants of other vehicles, or other roadway users.
- Another driver whose negligence resulted in injuries to the Lyft driver or passenger.
Accidents Caused by a Lyft Driver
If the Lyft driver’s negligence caused the claimant’s injury, they can seek compensation through either the driver’s personal auto liability policy or Lyft’s third-party insurance policy. There are three tiers of insurance coverage involved, and the insurance policy that compensates the claim depends on when the crash occurred.
If the crash occurred when the Lyft driver had their app on and was either transporting a passenger or en route to pick one up, Lyft offers a one million dollar third-party liability policy. The claim must first be submitted to the driver’s personal policy, with Lyft being a secondary resource for compensation if the driver’s insurer denies the claim.
If the crash occurred while the Lyft driver had their app on and was waiting for a ride, Lyft provides a third-party policy that offers bodily injury coverage of up to $50,000 per person or $100,000 per accident, as well as property damage liability coverage of up to $25,000 per accident. If the driver did not have their app on and was using their vehicle for personal reasons, then their own auto liability coverage would likely be the source of compensation.
Accidents Caused by Another Driver
If a LaGrange Lyft accident is caused by another driver and results in injuries to the Lyft driver or their passenger(s), then the at-fault driver’s personal auto liability insurance policy is generally the one you would file your claim against.
How a LaGrange Lyft Accident Attorney Can Help with Your Claim
An experienced Lyft accident attorney in LaGrange provides a number of services to assist their clients in obtaining compensation for their injuries. In addition to determining the source of liability, the attorney can help value the claim by calculating the expenses and impacts that were incurred, the severity of the injury, and how much compensation is available through the liable party’s liability insurance policy.
Gathering Evidence
The type of evidence involved in proving a LaGrange Lyft accident claim can include photographs from the accident scene that depict visible injuries, damage to the vehicles involved, and other information such as the traffic and weather conditions when the crash occurred, statements from eyewitnesses about how the accident occurred, the police report with information about arrests or citations that took place as a result of the accident, and driver information from Lyft.
The type of evidence that can prove the expenses and impacts of the claimant’s injury include all bills related to the medical care they received, employment documents reflecting the income they made before the injury as well as the time they claimant missed from work while they were recovering from the injury, and testimony from medical experts about the claimant’s prognosis following the injury.
Communicating with the Insurance Provider
After an accident involving injuries, the claimant’s attorney will handle communication with the at-fault party’s insurance provider in order to protect the claim’s value from being diminished by any number of insurance company tactics that are used to reduce or even eliminate personal injury claims. Additionally, the attorney will demand that the provider pay the full value of the claim, and will negotiate a settlement that fairly compensates the claimant for the injuries they received in a LaGrange Lyft accident.
Helping the Claimant Understand the Importance of a Fair Settlement
The legal team at John Foy & Associates believes that communication with their client is one of the most important services they can provide. This is because the attorney is not the one determining whether to accept a settlement or file the claim in court as a personal injury lawsuit — the client is. The attorney’s role is to ensure that the client has enough information to make decisions about their claim that reflect their best interest.
Litigation
Most Lyft accident claims are resolved before they go to trial. However, litigation is an important option to have in the event that the at-fault party’s insurer fails to pay the claim or provide a offer that fairly settles it. In Georgia, Lyft accident lawsuits must be filed within two years of the date on which the injury occurred in order for the claimant to retain their right to seek compensation for their injury.
Assistance Collecting the Claimant’s Compensation
Because the attorney works on a contingent-fee basis, they will not get paid for their services until the claimant has a positive outcome to their claim. The insurance company will send the proceeds of the settlement or award to the attorney, who will deduct their payment and any other debts they were obligated by the contingent fee agreement they entered into with the client, and the remainder of the compensation is released to the claimant.
