Opportunities for Financial Compensation and Justice
One of the top reasons more injury victims do not take action after being involved in a big rig accident is that they are unsure what options are available. The thought of being accused of filing a frivolous lawsuit is enough to prevent many victims from fighting for the compensation and benefits they may have otherwise been entitled to.
Fortunately, your truck accident lawyer in Peachtree Corners, GA will be by your side to help you explore the opportunities that are best suited for your case.
Filing a Truck Accident Lawsuit
First, you may have the opportunity to file a civil lawsuit. Here, your truck accident lawyer will file a claim against the individual or entity who is responsible for causing your injuries. We will seek total compensation for every loss you have suffered due to this party’s negligence or misconduct.
Generally, this might be against negligent truck drivers, irresponsible or reckless trucking companies, and auto parts designers or manufacturers. However, the way in which your truck accident occurred will help your attorney figure out who is to blame.
Filing a Claim with the Insurance Company
Another way you can recover compensation for your damages is by filing a claim with the insurance company. Georgia follows fault-based systems when it comes to insurance claims. This means even if you purchased your own personal injury protection coverage, you would file a claim with the liable party’s auto insurance provider after a collision.
Your truck accident attorney in Peachtree Corners, GA can evaluate the details of your case to determine whether you should also file a claim with your own insurer. You may have the opportunity to do so, but this may increase the amount you are required to pay in premiums when your policy renews. For this reason, it may be in your best interest to stick with a claim against the liable party’s insurer.
How Insurance Claims Work for Truck Accidents in Peachtree Corners
After you have been involved in a commercial truck accident, you will work with your attorney to determine how to file an insurance claim if doing so is a good option for you. Typically, truck drivers are covered by their trucking companies’ insurance coverage. This means you will file a claim with the trucking company’s insurance company instead of the truck driver’s own personal auto insurance coverage.
After your lawyer files a claim with the insurance company, the insurer may attempt to deny you the benefits you deserve. This is not always the case, but since insurance companies lose money by settling claims, you can certainly expect some pushback from the insurer. Your Peachtree Corners truck accident attorney will negotiate with the insurance company to hold them accountable.
However, if the insurance company attempts to delay the processing of your truck accident claim, misinform you about what types of coverage are available, or otherwise attempt to prevent you from accessing the compensation you deserve, your attorney will be prepared to take further legal action.
What Truck Accident Insurance Claims Cover
Unfortunately, truck accident insurance claims do not provide compensation for every single loss. Insurance claims are designed to provide compensation for specific types of damages.
For example, property damage liability coverage is required for all drivers in Georgia at a rate of $25,000 per accident. If you were involved in an accident, the minimum coverage the liable truck driver should have is $25,000. This will cover up to $25,000 in property damages.
However, if the liable party does not have sufficient insurance coverage, you may be stuck with a remaining balance. There are other types of damages that insurance will not cover. For example, you may be hard-pressed to find an insurer who is willing to provide compensation for pain and suffering damages. Fortunately, there are alternative opportunities for financial relief.
Minimum Truck Accident Insurance Requirements in GA
All motorists in the state of Georgia are required to purchase auto insurance coverage. Every motorist is required to purchase a minimum of $25,000 in property damage liability coverage and $25,000 per person, and $50,000 per accident in bodily injury liability coverage.
However, trucking companies may be required to purchase different limits depending on where the truck is registered. Additionally, trucking companies may also have higher coverage limits since tractor-trailers are far more likely to be involved in collisions.
Insurance Tactics to Beware Of
Insurance claims can be difficult to cope with. Since insurance companies often attempt to reduce payouts and deny claimants the compensation they deserve, it is important to be aware of some of their most unscrupulous tactics.
For example, some insurance adjusters will seem very polite to get you talking. Then, they will manipulate any statement you give in an attempt to make it appear as though you are to blame for causing the accident.
This could harm your ability to get the most out of your claim. Fortunately, with your truck accident lawyer in Peachtree Corners by your side, you can protect yourself from being taken advantage of.
