How to Know If You Have a Slip and Fall Case in Peachtree Corners

A lot of slip and fall victims are worried that they don’t have a valid case. It’s often because good people are prone to blaming themselves or not wanting to “cause trouble.” But seeking compensation for your damages is your legal right, and there’s no shame in bringing a case for the costs you didn’t fully cause.

Plus, when you file a personal injury claim for a slip and fall accident, you are mostly dealing with the insurance company—not the property owner or business directly. Your damages are typically covered by the at-fault party’s insurance policy, not straight out of their pockets.

All property owners and occupiers in Georgia have a duty to “exercise ordinary care” and maintain safe premises for those who come onto their property (Georgia Code § 51-3-1). If the owner or occupier fails in that duty and someone gets injured, they are liable for the damages.

Basically, if you were injured on someone else’s property in Peachtree City because of their negligence, you likely have a valid slip and fall case.

Causes of Slips and Falls on Property in Peachtree Corners

Slip and fall accidents often happen because of some hazard or unsafe condition on the property. If the hazard or dangerous condition hadn’t been present, you wouldn’t have fallen and gotten injured as you did.

Examples of conditions that lead to slip and fall accidents include:

• Wet flooring from water, spilled products, mopping, or waxing
• Uneven pavement or walkways
• Merchandise in the aisles
• Frayed or curled up rugs or carpeting
• Unmarked steps up or down
• Poor lighting

These are examples of premises liability hazards. Although the presence of a hazard doesn’t automatically mean a valid case, it’s a sign of negligence if the business or property owner fails to notice, fix, and/or notify customers of an unsafe condition within a reasonable amount of time.

A premises liability lawyer in Peachtree Corners can help you investigate the details of your case, determine who was at fault, and help you build a strong claim. To get help with your case starting today, call us for a FREE consultation at (404) 400-4000 or contact us online.

Five Things to Do Right After a Slip and Fall Accident in Peachtree Corners

After a slip and fall accident, it’s very important to be your own best advocate. You can do this by immediately thinking about how your actions can support your case. The sooner you can document what happened, the better.

Here are some of the ways you can start gathering information for your injury claim on the same day as your accident.

1. If You Need Emergency Treatment, Get It

Don’t delay getting medical attention for your injuries. Although it can be so beneficial to stay at the scene and document things, don’t neglect any immediate needs. If you need treatment right away and it cannot wait, call 911 or have someone call for an ambulance.

If you are well enough to stay at the scene, continue with the following steps.

2. Take Pictures of Where Your Accident Happened

Put your phone to good use. Take pictures of:

• Where you fell
• The hazard or obstacle that caused your fall
• Where you were walking right before you fell
• The overall scene of your slip and fall accident
• Anything else that helps document what occurred, such as showing that there were no warning signs about the hazard

Most slip and fall accident scenes can be fixed or cleaned up quickly. To prevent the property owner or store employees from removing any evidence of your accident, you can preserve it forever with pictures.

3. Get the Contact Information of Any Witnesses

Much of the time, there are witnesses nearby during slip and fall accidents. If anyone else saw you fall or saw the hazard that caused your fall, talk to them. Ask if you can have their names and contact information.

Your slip and fall accident lawyer will want to reach out to witnesses as they build your case. Witness statements can be incredibly powerful for a premises liability claim.

4. Tell a Manager About Your Accident

Make sure the property owner or manager of the business knows about your accident. If you’re not sure how to find them, ask an employee. Tell them what happened and make sure they understand that you fell and were injured on their property.

When you report the accident, stick with the facts and do not admit any fault or apologize. Even if you feel you might have been partially responsible for your fall, wait to speak about it with your lawyer. Don’t say anything that could be used against you later.

5. Contact a Slip and Fall and Premises Liability Lawyer

After you gather as much information as you can on the day of the accident, contact a slip and fall lawyer as soon as possible. They can help you compile additional evidence to build your claim and handle the legal side of things for you.
