What Should I Do Immediately After Being Hit by a Police Car?
If you have been hit by a police car as a motorist or a pedestrian, take the following steps immediately after the accident:
- Seek medical care: Your health and well-being should be your top priority. Check yourself and others involved in the accident for any injuries. If anyone is injured or experiencing pain, call for emergency medical assistance right away.
- Report the collision: Contact the local police department to report the accident. Provide them with accurate details of the incident, including the location, time, and any other relevant information. It’s important to have an official record of the accident, especially when a law enforcement vehicle is involved.
- Assemble information: Collect as much information as possible at the scene of the accident. This includes the name, badge number, and contact information of the police officer involved in the collision. Additionally, gather information from any witnesses, such as their names and phone numbers. Take photos or videos of the accident scene, including all damages.
- Preserve evidence: Preserve any evidence related to the accident. This can include keeping copies of medical records, photographs, and any other relevant documents. If there were any dashboard cameras or surveillance cameras in the vicinity, note their locations and inform your attorney about the potential availability of additional evidence.
- Consult with a reputable attorney: Contact an experienced car accident attorney, particularly one who focuses on cases involving law enforcement vehicles. An Atlanta personal injury lawyer will help you pursue fair compensation for your injuries and damages. It’s advisable to consult with an attorney before making any statements or accepting any settlements.
- Notify your insurance company: Contact your insurance company to inform them about the accident. Provide them with accurate details and cooperate with their investigation. However, it is recommended to consult with your attorney before providing a formal statement to the insurance company.
What Are My Chances of Winning a Settlement in a Police Collision Case?
Determining the chances of winning a settlement if you are hit by a police car can be complex, as it depends on various factors specific to your case. The following key considerations can influence the likelihood of success:
Liability
Establishing liability is crucial in any car accident case, including those involving police collisions. Your attorney will need to gather evidence to demonstrate that the police officer involved in the collision acted negligently or recklessly, that there was a lack of shared fault, and their actions directly caused the accident and your injuries.
Evidence
The strength and quality of the evidence you have to support your claim play a significant role in the chances of winning a settlement. Documentation of injuries, medical records, photographs of the accident scene, and any available video footage often build compelling and comprehensive evidence.
Legal Experience
Engaging an experienced car accident attorney in Georgia who focuses on cases involving law enforcement vehicles is crucial. For instance, our firm has the knowledge, skills, and resources to navigate the complexities of such cases, understand applicable laws, and build a strong legal strategy on your behalf.
Police Immunity
In some jurisdictions, police officers may enjoy certain legal protections or immunities that can make it more challenging to hold them liable for their actions. Your attorney will be familiar with the specific laws in your jurisdiction and can assess the potential impact of those immunities on your case.
Insurance Coverage
The availability and extent of insurance coverage, both on your part and on the part of the police department or municipality, can impact the potential settlement amount. Your attorney will analyze the insurance policies involved and determine the maximum recovery possible.
Negotiation Skills
Settlement negotiations play a crucial role in reaching a favorable outcome. An experienced attorney will possess strong negotiation skills to advocate for your rights and maximize your chances of obtaining a fair settlement. If a settlement cannot be reached, they can guide you through the litigation process.
Is There a Deadline for Filing an Accident Claim if a Police Car Hits You?
Regardless of whether you are a pedestrian or a motorist, if you are hit by a police vehicle, there will be a deadline for filing a personal injury claim. According to Ga. Code § 9-3-33, the standard statute of limitations for personal injury cases, is typically two years from the date of the accident.
However, when dealing with claims against government entities, such as the Atlanta police department, the concept of sovereign immunity comes into play. Sovereign immunity can impose limitations and additional complexities on filing claims against government entities.
Consulting with an experienced car accident attorney to understand the specific deadlines and requirements that apply to your case will help you to avoid forfeiting your right to a settlement.
