Understanding the Workers’ Compensation System in South Carolina
The workers’ compensation system in South Carolina helps employees who are injured on the job. This is a no-fault system, meaning you don’t have to prove your employer was at fault to get benefits. However, there is a tradeoff. In exchange for this easier access to benefits, workers’ compensation usually prevents you from suing your employer directly.
There are exceptions to this rule, though. For example, if a third party, like a contractor or another company, caused your injury, you can file a lawsuit against that outside party while still receiving workers’ compensation benefits.
Additionally, if your employer does not carry the required workers’ compensation insurance, you could sue them directly for damages. Our workers’ compensation attorneys in Beaufort will work to make sure you get the compensation you need.
Who Is Eligible for Workers’ Compensation Benefits?
In South Carolina, most employers with four or more workers are legally required to carry workers’ compensation insurance. There are some exceptions to the general rule, including:
- Casual workers who are hired occasionally and don’t have a set schedule
- Farm and agricultural laborers
- Individuals selling farm products
- Employees working for railroads or railway express companies
- Federal employees working within the state
- Licensed real estate agents affiliated with a broker
These exceptions mean that not every worker is automatically covered. A Beaufort workers’ compensation attorney will determine whether your job falls under the protection of the workers’ compensation system.
Are You Eligible for Workers’ Compensation Benefits?
Most employers are required by law to carry workers’ compensation insurance. However, filing a claim can be confusing, and sometimes valid claims are delayed or denied. That’s why having a knowledgeable workers’ compensation lawyer on your side can make a big difference in getting the help you need.
You may be entitled to workers’ compensation benefits in South Carolina based on:
- Employment status: You are an employee of a business that is legally required to carry workers’ compensation insurance. In South Carolina, most employers with four or more employees are mandated to have this coverage.
- Nature of injury: Your injury or illness occurred in the course of your employment. This means the injury happened while you were performing job-related duties or as a direct result of your work activities.
- Timely reporting: You reported the injury to your employer within 90 days.
- Filing deadline: You file a formal claim for benefits within two years from the date of the injury or diagnosis.

Workers’ Compensation Benefits You Can Recover
A work-related injury or illness can turn your life upside down. If you can’t work, you may lose your income, making it hard to cover medical bills and everyday expenses. This can be especially tough if your family depends on you financially.
As an employee hurt on the job, you could receive several types of workers’ compensation benefits, including:
- Coverage for medical treatment
- Compensation for lost wages
- Payment for permanent scarring or visible injuries
- Benefits for partial or total permanent disability (TPD)
At John Foy & Associates, we know that even a small accident can put your financial future at risk. Our workers’ compensation lawyers help you track and document every loss to make sure you get the support you need.
You Have a Limited Time to File a Workers’ Compensation Claim
State law gives you a limited amount of time to file for workers’ compensation benefits. You must generally report your injury to your employer within 90 days. Then, you typically have up to two years to file a formal claim with the South Carolina Workers’ Compensation Commission.
If you miss these deadlines, you could lose your right to receive benefits like medical care or wage replacement. Don’t wait; report your injury and speak with a workers’ compensation attorney as soon as possible to protect your rights.
