Why Should You Hire a Workers’ Comp Lawyer?
An employer will look for any reason to contest a workers’ compensation claim. A workers’ compensation attorney in Lexington knows what the claims process entails and the challenges you will face along the way. They gather evidence, submit your claim, and keep you updated.
If your workers’ comp claim is rejected, you can appeal. A workers’ comp attorney finds out why your benefits request was denied and discusses your appeal options with you. Next, they prepare a case that could prompt a reversal of your denial.

Workers’ Compensation Benefits in Lexington That You Need to Know About
The South Carolina Workers’ Compensation Commission offers injured worker FAQs to those who are coping with a work-related injury or illness. These answers provide insights into the workers’ comp benefits available in South Carolina, including:
Medical Benefits
Treat your work injury or illness and track your medical care expenses. A Lexington workers’ compensation lawyer can help you recover benefits for your hospitalization, surgery, prescription, and other medical costs.
Lost Wages
You could receive compensation for your lost wages if your injury or illness prevents you from working. In this scenario, you could get two-thirds of your average weekly wage through a workers’ comp claim.
Permanent Disability
If your injury or illness causes a permanent disability, you may be entitled to workers’ comp benefits. Permanent disability benefits are usually capped at 500 weeks. If you are dealing with a total disability due to brain damage or paralysis, you could receive benefits for the rest of your life.
Along with these workers’ compensation benefits, some workers are eligible for vocational rehabilitation services so they can reenter the workforce after they suffer a job-related injury. Alternatively, following a fatal work accident, a late employee’s surviving family members could obtain death benefits and compensation for the worker’s funeral and burial expenses.
When Should You File a Workers’ Compensation Claim?
You have 90 days from the date you experience a work-related injury or illness to notify your employer. If warranted, get emergency care for your injury or illness and inform your employer as soon as you can afterward. Otherwise, if 90 days elapse, you may be ineligible for workers’ compensation benefits.
With your South Carolina workers’ compensation claim, your employer can choose your treating doctor. If you receive medical treatment from a doctor whom your employer has not approved, your workers’ comp claim can be denied.
A Lexington workers’ compensation attorney protects your legal rights and best interests. They help you avoid mistakes as the workers’ comp claims process moves forward. Your attorney guides you through this process and ensures it is difficult for your employer to fight back against your benefits request.

What to Do If Your Workers’ Comp Claim Is Denied
Partner with a workers’ compensation lawyer who has helped past clients achieve outstanding case results if you find out your claim has been denied. Your attorney can file a Form 50 (for workplace injuries) or Form 52 (for workplace deaths) to appeal and request a hearing with the Workers’ Compensation Commission.
During an initial hearing, a workers’ compensation commissioner evaluates your case. If your benefits request denial is affirmed, your attorney can proceed with an appeal to a panel of commissioners.
A full commission panel is typically made up of three commissioners who will review your benefits request. If the panel denies your request, your lawyer can appeal to the South Carolina Court of Appeals.
