Why Is It Hard to File an Uber Accident Claim Without a McDonough Uber Accident Lawyer?
Car accident laws are unambiguous regarding fault, comparative negligence, and compensation elements after an Uber accident, and it’s possible to file the claim without legal representation.
Many plaintiffs have filed successful Uber accident claims without legal counsel. However, circumstances vary, and there’s no assurance that the same will happen in your case as you’ll likely experience the following challenges:
Complex Insurance Laws
Rideshare vehicles have unique insurance requirements that must be considered when determining the possible settlement. Generally, an Uber vehicle’s insurance coverage hinges on its status when the accident occurred.
- Suppose the car had a passenger in it or was headed to pick up a passenger. In that case, it carries commercial liability coverage of one million dollars and an equal amount in underinsured/uninsured motorist coverage.
- If there was no passenger, but the driver was on duty awaiting a passenger dispatch, the vehicle will have property damage coverage of $25,000, $50,000 for bodily injury, and $100,000 as bodily injury coverage for multiple victims of the same accident.
- Uber drivers use personal vehicles. So if they have an accident when they’re not on duty, they’ll only have their automobile insurance policy coverage.
The above requirements have made numerous accident victims lose their claims, so you must know what you’re entitled to and fight for it.
Determining Fault Level for the Uber Accident
The comparative negligence rule applies to Uber accidents in McDonough. This concept refers to situations where several parties are partially to blame for a crash.
State laws allow you to recover damages against any at-fault party, but your share of liability matters. Your possible compensation will be reduced proportionately to a percentage corresponding to your degree of liability. As expected, the responsible party or their insurer will do everything to blame you partially, and you don’t want unnecessary deductions.
Strict Deadlines for Filing Accident Claims
Laws in every state define specific deadlines for filing accident claims against negligent parties, known as the statute of limitations. Plaintiffs seeking legal remedies in McDonough must comply with Georgia’s deadline of two years for personal injury claims and four years for property damage.
You can’t wait too long as it could limit you from getting the deserved compensation or even invalidate your claim. Considering the above complications, it’ll be risky to file a claim without a lawyer. Involving an attorney can help you navigate the hurdles and file your claim on time.
How Can an Uber Accident Attorney in McDonough Help?
A knowledgeable Uber accident lawyer in McDonough can help your case in different ways. After reviewing the specifics of your case, they’ll explain the available legal options and compute your claim’s value. Involving them can help maximize your claim, and you won’t be pressured into low-ball offers. Here’s how they’ll benefit your case:
Communicating with Insurers
Your Uber accident attorney can initiate a line of communication with the involved insurance adjusters to achieve your best interests.
Investigating All the Contributing Factors
Your McDonough rideshare accident attorney can examine any potential contributing factors to the Uber accident. There may be multiple factors involved, and detailed investigations will unearth them to determine the at-fault party. They’ll involve an accident reconstruction specialist where necessary.
Determining Liable Parties
An experienced attorney can identify the potentially liable parties based on their investigations, available evidence, and specialist insights.
Estimate Future Healthcare Expenses and Accident-Related Costs
An Uber accident attorney can assess all expenses arising from the incident, including the future cost of treatment and therapy. They’ll consult with your physician and other medical experts to accurately determine how much you’ll spend on the injuries you sustained.
Handle Insurance Adjusters
Your attorney understands that anything you say to insurance adjusters could affect your Uber accident claim. They’ll take over any communications with them to reduce the risk of claim invalidation and give you sufficient time to focus on recovery.
Handle Health Facilities and Debt Collectors Harassing You to Clear Bills
It’s easy for hospitals and lienholders to exploit you if you don’t know your rights and don’t want stress during recovery. Fortunately, your attorney can deal directly with debt collectors and hospital staff and save you from harassment by informing them of your pending claims.
Negotiations with Insurer
As a business, the insurance company will be inclined to protect its profit margin, hence will try to minimize what it pays out in claims. So don’t accept what they present to you as the initial offer because it’ll likely be low-ball. A McDonough Uber accident attorney is an excellent negotiator and can fight for what you deserve.
Fighting for the Appropriate Legal Remedies
Your Uber accident claim is meant to seek compensation from the responsible party. There’s no specific legal amount for Uber accidents, and different damages will determine how much you’ll get. Your attorney can seek compensation comprising compensatory and punitive damages.
Compensatory damages cater to the financial, emotional, and physical impacts of the Uber accident. They comprise:
- Economic damages – This is remuneration for tangible financial implications of the Uber accident, including hospital bills, medication, therapy, lost income, and damaged property.
- Non-economic damages – This is compensation for physical or subjective harm to an individual, including pain and suffering, emotional trauma, scarring, or reduced quality of life.
Punitive damages are rare, only awarded as punishment when the case involves extreme negligence or malice. Your attorney can include all the relevant elements to ensure the compensation ultimately covers all your losses.
