According to a study from the University of Chicago and Rice University, rideshare collisions have increased traffic deaths by 2 to 3%, which is the equivalent of over 1,000 fatalities every year. That is why, if you have been harmed in one of these rideshare crashes, it is time to fight back and go after the monetary damages and justice you deserve. Fortunately, with an experienced McDonough personal injury attorney on your side, you will not have to take on this legal fight alone.
Who Is at Fault for a McDonough Rideshare Accident?
When it comes to rideshare accidents, there can be numerous parties liable for the collision and the resulting damages, including:
The Rideshare Driver
If a rideshare driver was reckless or negligent and caused an accident, they can be held responsible for the crash and the resulting injuries.
The Rideshare Company
Because most rideshare drivers are labeled as independent contractors, it is challenging to hold a rideshare company directly accountable for any harm and losses that occur, even if it was their driver who caused the accident.
Yet, although these drivers are not employees, it is still possible to be covered by a rideshare company’s insurance policy if you were involved in an accident with a rideshare driver.
Third Parties
With a lawyer’s help, you may discover that the rideshare driver may not have actually caused the collision. Instead, it may have been a third party whose negligence caused the crash, such as another motorist, trucker, pedestrian, or motorcyclist.
Monetary Damages You Can Pursue Following a McDonough Rideshare Accident
If you sustained injuries in a rideshare accident in McDonough, you may be entitled to pursue certain types of compensation. In Georgia, this includes the following types of damages:
Economic Damages
These damages refer to the actual monetary losses that result from an accident. They include compensation for:
- Medical bills
- Lost wages and reduced earning capacity
- Personal property damages
- Domestic replacement services
Non-Economic Damages
These damages refer to the rather subjective losses that result from an accident. These damages are generally not easy to quantify and tend to be hard to prove. They include losses related to:
- Pain and suffering
- Disfigurement, scarring, or limb loss
- Loss of enjoyment of life
- Loss of companionship
You may also be able to file for punitive damages, which are used to punish the responsible party and deter others from doing the same in the future. For these reasons, these damages are not awarded in every personal injury claim, but rather, only when a McDonough rideshare accident lawyer can show that the defendant acted with willful misconduct, malice, fraud, wantonness, and oppression.
Time Limitations to Pursue an Injury Claim Following a McDonough Rideshare Accident
In Georgia, if you sustained injuries in a McDonough rideshare accident, you will only have two years from the accident date to file a claim. This period of time is known as the statute of limitations, which is a law that refers to the amount of time an individual has to pursue legal action against an individual or company who may have caused them harm.
If these individuals do not file their case within that allotted time period, they can be barred from pursuing the money they need for their injuries and losses.
That is why, following a McDonough rideshare accident, it is recommended you reach out to an experienced McDonough rideshare accident attorney as soon as possible. These lawyers can help you figure out the maximum amount of time you have to file your case and ensure that all of your documents are prepared and submitted to the proper court before time runs out.
