Workers’ Compensation In Georgia
Georgia’s workers’ compensation program is a no-fault insurance system that provides benefits to employees when they suffer work-related injuries or illnesses. The Georgia State Board of Workers’ Compensation oversees the program and ensures compliance.
The intent is to avoid complex legal situations where employees need to sue their employers in order to get compensation when they are injured. However, even though you don’t need to prove fault, disputes may arise, or your claim may be denied.
In order to qualify for workers’ compensation in Georgia, you must be an eligible employee injured on the job, report the injury within 30 days, and get treatment from an approved provider. Most employers with three or more workers are legally required to provide coverage.
How Our Workers’ Comp Lawyers Can Help
If your workers’ compensation claim has been delayed, denied, or called into question, our workers’ compensation attorneys will help you understand your rights and work to get the compensation you deserve.
Our attorneys are experienced with the complex rules that govern workers’ compensation in Georgia. It’s tough to manage your case on your own, especially when you are recovering from an injury. Skilled, professional assistance can help you avoid potential issues.
While the system is designed to be straightforward, employers or insurance companies may deny your claims or attempt to underpay benefits. Our workers’ compensation attorneys in Martinez will make sure you are treated fairly.
Evaluate Your Claim
Our attorneys will review your case to determine if you’re eligible for benefits under Georgia law. If so, we can identify the range of benefits you are entitled to and begin working on your claim. If your claim has already been denied, we’ll investigate and seek evidence that shows the denial was incorrect.
Handle the Paperwork
Sometimes, denials and delays happen due to simple paperwork mistakes. Our attorneys know the process and can ensure forms are completed correctly and filed on time. We’ll help prevent mistakes that could otherwise jeopardize your claim, reducing the risk of delays or denials.
Challenge Denials or Disputes
If your claim is denied or your benefits are reduced, your workers’ compensation lawyer can represent you in hearings before the State Board of Workers’ Compensation. We will present evidence, question witnesses, and argue to prove that you are entitled to the benefits you’ve claimed.
Negotiate Settlements
Your workers’ compensation attorneys in Martinez will evaluate any settlement offers and determine if they are fair based on your current and future needs. We’ll negotiate with insurance companies to achieve a result that makes a difference in your life and covers allowable expenses.
Support and Peace of Mind Throughout the Process
The workers’ compensation process can be frustrating and confusing, especially if you’ve experienced a denial. With your team on your side, you’ll have the peace of mind knowing your claim is in good hands while you focus on recovering from your injury or illness.
What Benefits Are Available Through Workers’ Compensation in Georgia?
Georgia’s workers’ compensation benefits are designed to cover your medical expenses, lost wages, and more, so you can recover physically and financially after a work-related injury or illness.
Our Martinez workers’ compensation lawyers can help you understand what benefits you are entitled to. This may include:
Medical Treatment
Workers’ comp can cover medical care such as doctor visits, surgeries, hospital stays, prescriptions, and physical therapy. However, you must receive treatment from a doctor on your employer’s approved list of physicians.
Wage Replacement
If you are unable to work for more than seven days due to a job-related injury or illness, you may be eligible for weekly wage replacement benefits under Georgia workers’ compensation law.
- Temporary Total Disability benefits pay two-thirds of your average weekly wage, based on your earnings during the 13 weeks prior to your injury, up to a maximum limit set annually by state law.
- If you are medically cleared to return to work in a limited or lower-paying role, you may qualify for Temporary Partial Disability benefits. TPD helps cover the difference between your pre-injury wages and your current reduced earnings.
Permanent Disability
If your work-related injury or illness leads to a permanent impairment, you may qualify for Permanent Partial Disability benefits. These payments are determined by the type and extent of your injury, following a schedule established by Georgia law.
Vocational Rehabilitation Services
Vocational rehabilitation may help you re-enter the workforce when you are unable to return to your previous job. You can participate in job retraining, career counseling, and receive assistance in finding new employment that is suited to your abilities and limitations.
Death Benefits for Surviving Dependents
If you are the surviving dependent of a worker who passes away because of a job-related injury or illness, you may be entitled to death benefits. These include weekly payments and coverage of funeral expenses.
