What Does a Workers’ Comp Lawyer Do?
Your workers’ compensation attorney in Lovejoy handles your claim while you recover from your workplace accident and injuries. Initially, your lawyer will ask you questions and find out how you were hurt. Next, they will help you file your workers’ compensation claim and put you in a great position to get your benefits request approved.
For those who have had their workers’ comp claim denied, your lawyer will get to the root of the issue. Outside of the medical records and other documentation you submitted with your claim, your attorney can gather additional proof to support it. From here, they can file an appeal and craft an argument that makes it clear why your claim denial should be overturned.
The workers’ comp attorneys at John Foy & Associates are collaborative, supportive, and encouraging. We offer a Georgia workers’ compensation settlement chart and other resources to those going through the workers’ comp claims process. Trust us to help you with your workers’ comp claim. How to File a Workers’ Compensation Claim in Lovejoy
At first glance, Georgia’s workers’ compensation claims process may seem like it is more trouble than it is actually worth. Thankfully, you do not have to go through this process alone. Your Lovejoy workers’ compensation lawyer will assist you with your claim. They will explain the stages of the workers’ compensation claims process, which are as follows:
- Notify your employer about your injuries: You have 30 days from the date you get hurt on the job to tell your employer about your injuries. Inform your employer in writing and include details about the date, time, and location of your workplace accident and the severity of your injuries.
- Fill out Form WC-14: You can file your claim by completing Form WC-14 and submitting it to the State Board of Workers’ Compensation. Also, provide a copy of this form to your employer and their insurance carrier.
- Await a response: Your employer’s insurer will investigate and assess your claim and may offer a settlement. If warranted, your attorney will negotiate a settlement, which may allow you to get money for your medical bills and lost wages.
If your workers’ comp claim is denied, you have the right to appeal. Your attorney can provide insights into how an appeal works. When you submit an appeal, your lawyer will do everything within their power to help you get results that match or exceed your expectations.
What to Expect if You Appeal a Denied Workers’ Compensation Claim
Your Lovejoy workers’ compensation attorney understands the challenges you will face if you appeal a denied claim. Regardless, your lawyer is ready to tackle any issues that come up during the appeals process. They will share FAQs with you and address any concerns you have as this process moves forward.
In an appeal, you can dispute the denial of your claim as a whole or certain aspects of it. Once your lawyer files your appeal, your case will go to an administrative law judge (ALJ) for review. At this point, the judge hears your argument and that of your employer’s insurance company. They will decide whether to affirm the denial or approve your benefits request.
Having an ALJ rule against you can make you question whether to give up on your claim. Yet, your lawyer may advise you to appeal to the State Board’s Appellate Division. With this option, you have 20 days from the date of the ALJ’s decision to appeal. If the Appellate Division upholds the denial, you can appeal further to the Georgia Superior Court.
