If you’ve been injured in an incident that happened while you were at work for Southwest Airlines, you’re probably unsure how you’ll get the money you need to recuperate from your injuries and losses. While you might be familiar with the term “workers’ compensation,” you might not know how to file a winning claim.
Fortunately, the Atlanta Airline workers’ compensation lawyers at John Foy & Associates have helped individuals like yourself file winning claims for two decades. We’ll do everything we can to ensure your Georgia Southwest Airlines workers’ compensation claim is filed correctly, giving you an excellent chance at receiving a fair settlement.
Who Can File a Southwest Airlines Workers’ Comp Claim in Georgia?
Many injured workers don’t pursue well-deserved benefits from their employer’s worker comp insurance policies because they believe they don’t qualify to file. This couldn’t be further from the truth for many injured airline workers.
According to workers’ comp laws in Georgia, companies that employ at least three workers are legally required to carry workers’ comp insurance. Therefore, if you were injured while working for Southwest Airlines, you’ll be covered by the company’s insurance.
Your coverage starts your first day on the job, so no matter when your accident occurs, you have the right to file a claim. The company’s insurance covers all workers, no matter how large or small their roles are in the organization. For example, any of the following employees can file a Southwest Airlines workers’ compensation claim in Georgia:
- Aircraft fuelers
- Station attendants
- Pilots
- Aircraft mechanics
- Flight attendants
- Baggage handlers
- And more
Benefits You Can Receive From a Southwest Airlines Workers’ Comp Claim
A serious workplace accident can leave you with medical expenses, lost income, and even a life-altering disability. Luckily, a committed attorney can calculate how much compensation you need to address the challenges you’re facing and fight for the settlement you deserve. If your workers’ comp claim is successful, you could obtain any of the following benefits:
Medical
When you’re dealing with an injury, medical treatment is almost always a requirement, but it can be incredibly expensive. Even minor injuries can require costly doctor’s visits, prescriptions, and other forms of treatment. The good news is that the medical benefits you receive from a claim can cover all these expenses and more.
When you work with a Georgia attorney, they’ll file a Southwest Airlines workers’ comp claim for the following medical costs:
- Hospital bills
- Ambulance fees
- Cost of medical appointments, surgeries, and procedures
- Cost of medications, assistive medical devices, and physical therapy
- And more
Lost Wages
If your injury is severe, your doctor may advise you to take time off of work. While staying home from work can help with the healing process, it can also create a lot of financial stress and make it difficult for you to keep up with your bills. That’s why workers’ comp provides weekly, tax-exempt payments to make up for a portion of your normal pay.
Disability
If you’ve suffered a long-term injury in a Southwest Airlines work accident, it may qualify for workers’ comp disability benefits. The type of disability pay you receive from a claim will depend on how severe your injury is. An attorney can determine which type of disability pay you’re entitled to and fight to obtain it.
Death Benefits
If your spouse or family member has passed away in a Southwest Airlines accident, you may be eligible to file a workers’ comp claim on their behalf. If you’re entitled to seek compensation, you could receive death benefits, which can help pay for funeral costs and offer some financial support to you and your family if you relied on the decedent’s wages.
How a Georgia Workers’ Compensation Attorney Can Help
Filing an effective workers’ compensation claim requires a great deal of experience and a number of steps. A skilled attorney will know exactly what to do to get the most out of your claim. Here are some of the actions a lawyer will take to get the benefits you’re owed:
- Investigate your accident
- Work with engineering experts and other professionals to determine what caused the incident
- Use evidence to build a solid workers’ comp claim on your behalf
- File your insurance claim and negotiate a settlement with insurers
- Appeal denied claims
- Comply with the statute of limitations for workers’ comp claims
- Keep you updated on your case throughout the entire claims process
As you can see, a winning claim requires a lot of hard work. If you’re in need of workers’ comp benefits, you probably won’t be able to file a claim on your own. Even if you had the time and energy to do so, you might make a mistake that could cost you your compensation. Instead of straining yourself during your recovery period, let a committed attorney take on your claim.
