Our Lexington Motorcycle Accident Lawyers Are Here to Answer Your Legal Questions
We understand that the aftermath of a motorcycle accident can leave you with serious questions about your recovery. Fortunately, our attorneys have decades of legal experience. We not only understand the law, but we also have the means to break down the statutes that apply to your specific situation.
You can book a free case consultation with our team and bring forward any questions you might have about your right to recover. In turn, we can explain:
- How you can use evidence to name a liable party
- How proving that someone violated their duty of care entitles you to financial compensation
- How you can interact with insurance companies after an accident
- How you can take a liable party to civil court
- What compensation you can ask for based on your losses
Scheduling a case consultation with our team doesn’t obligate you to continue with a civil case. It’s entirely up to you to decide how you want to recover from your losses. We’re here as your allies, no matter how you choose to proceed.
We Defend Your Right to Financial Support By Referencing Evidence of Negligence
Whether you’re arguing for accident damages via an insurance claim or a personal injury lawsuit, you need evidence to prove that someone else bears the responsibility for your losses. Fortunately, we can partner with experienced investigators to gather the data necessary to make such a case.
The evidence we can use to argue for your right to reasonable compensation after a motorcycle accident may include the following:
- Electronic data, including data from cellphones
- Camera footage from dashboard cameras, security cameras, and bystanders
- Bystander accounts of an accident
- Physical debris and environmental damage
- Photos from before and after an accident
- Statements from medical responders, police officers, and emergency personnel
- Pay stubs, invoices, and other documents indicating the extent of your financial losses
The evidence available to us will vary based on the nature of your accident. Fortunately, our team never takes a cookie-cutter approach to your recovery. You can trust our Lexington motorcycle accident attorneys to treat your case with the individual attention and care that it deserves.
We Can Break Down South Carolina’s Modified Comparative Negligence Policy
South Carolina’s civil courts operate on a modified understanding of comparative negligence (SC Code § 15-38-15 (2024)). So long as you are less than 51% liable for a serious collision, you can ask for motorcycle accident compensation.
This means that you have the right to argue for accident compensation even if you were partially responsible for our collision. However, we always recommend fighting back against accusations of shared fault. If you don’t, you risk reducing your final settlement by the percentage of fault you allegedly contributed to a collision.
In other words, say you stand to recover $100,000 after a motorcycle accident, but a liable party argues that you’re responsible for 20% of your own losses. Instead of receiving your promised $100,000, you will instead receive $80,000. This is 20% less than you would have gotten if you’d argued against accusations of fault.
Our Efforts Prioritize Your Right to Recover From a Collision
Unfortunately, there are parties that want to make it harder for you to recover from a motorcycle accident. Insurance claims adjusters can use tried-and-true tactics to slow down your claim-filing process or argue against your request for reasonable compensation. Liable parties can try to invoke South Carolina’s modified comparative negligence policy to deny you support.
Contesting these attempts to slow down your recovery is hard when you’re alone. Fortunately, you can turn to our team for support. We know how insurance companies can weaponize their policies against you, as well as how liable parties can try to twist the narrative of your accident.
That’s why we work to shield clients like you from false accusations and inappropriate questions. Our efforts ensure that insurers and civil representatives hear your voice and prioritize your need to recover.
