How Dacula Workers Are Protected By Workers’ Compensation

Workers’ compensation was set up to protect workers who get hurt on the job. Most employers have to purchase workers’ compensation insurance for their employees.

In Georgia:

• Any employer with three or more employees must provide workers’ compensation coverage.
• That includes employees who are full-time, part-time, or seasonal.
• Even the business is an LLC or incorporated, they likely still need coverage even with less than three employees.

There are a few exceptions to this rule, such as farm laborers, government agencies, and domestic servants.

Workers’ compensation protects injured workers by providing them with medical treatment and compensation for the costs of their injuries. Workers’ compensation also removes the need for a lawsuit because it is impossible to sue your employer.

How Fault Works in Workers’ Compensation Insurance

Unlike personal injury cases, the fault is not even considered with a workers’ compensation claim. The following details do not matter:

• Who caused the accident or injuries
• How you got hurt
• Whether or not you were hurt while performing work duties

If your injury happened at work, it should be covered. This applies even if you were doing something unrelated to your job duties.

Common Injuries Covered By Workers’ Compensation

Any injury that happens at work can be covered by workers’ compensation. Some of the most common ones we see include:

• Being hit by an object, such as merchandise or tools falling from shelves
• Slip and fall injuries
• Repetitive strain injuries from performing the same motion over and over again
• Injuries from faulty equipment or machinery
• Auto accident injuries (which are common in driving-heavy jobs like truckers)

Work injuries are most common in occupations like construction, steelworking, factory work, and roofing. However, workers’ compensation applies even in industries that are safer, such as desk jobs.

Any type of physical injury is covered by workers compensation. If you suffer from psychological or emotional trauma because of a physical injury, it may also be covered. However, there must be a physical injury present.

Sometimes, Injuries Outside of Work are Covered

There are certain situations where an injury might be covered even if you aren’t physically at your work site. You may be covered if you were hurt while:

• Operating a company car.
• Traveling for business.
• Attending a work meeting off-site.
• Working at a remote location.
• Running an outside errand as part of your job duties.

If you are unsure whether your injury is covered, contact a workers’ compensation lawyer in Dacula. You should also consult with a lawyer if the insurance company or your employer is trying to say an off-site injury doesn’t apply. They may just be looking for ways to avoid paying your claim.

Costs You Can Recover Through a Dacula Workers’ Compensation Claim

Workers’ compensation coverage is meant to protect you from the costs of your injury, so it includes losses like:

• Medical expenses, including doctor visits, tests, emergency care, hospital stays, and prescription medications.
• Lost wages from missed work time.
• The cost of travel to and from doctor visits.
• Physical therapy or other long-term treatment.

If your injury leaves you disabled or unable to perform the same work duties as before, you will be eligible for more benefits. Also, if someone is killed in a workplace accident, workers’ compensation may provide benefits to certain family members.

How to Make a Workers’ Compensation Claim

After being injured at work, you will need to file a claim with the Georgia State Board of Workers’ Compensation. You do this by completing a WC-14 form, which you can get from the Board’s website or in person.

You’ll then need to send a copy of the WC-14 to your employer and the insurance carrier that provides workers’ compensation. Your employer can help you get this information.

You will also want to contact a Dacula workers’ compensation lawyer as soon as possible. They can help you with the filing process and make sure all pertinent details are accounted for.

If your employer or the insurance company tries to deny any of your claim, your lawyer can fight for your rights.

What Happens If a Business does Not Purchase Coverage

It’s more common than you would think for businesses to not carry workers’ compensation insurance—even if they legally should. Not complying with the laws on workers’ compensation coverage is serious, and a business can face up to $5,000 per violation and one year in prison.

If you believe your employer should have coverage but doesn’t, you can contact the Georgia State Board of Workers Compensation for coverage verification. A workers’ compensation lawyer can also help you verify coverage.
