Even with the best safety gear, a car offers more protection in an accident. Motorcycle riders are at a much higher risk of injury and death from wrecks than other drivers. The consequences are high, which means the compensation needs to be high as well.
If you’ve been struck in a motorcycle accident and suffered an injury, don’t wait. Call our College Park personal injury attorneys at John Foy & Associates for a free, no-obligation consultation about your case. Let us help you get back on your feet and on the road again.
Did You Share Liability in Your Motorcycle Accident?
Liability is the name of the game in any accident case. And sometimes, both driver and rider share liability for injuries. Under Georgia law, as long as you are under 50% liable for your accident, you can claim damages.
If you didn’t wear a helmet or adequate safety gear at the time of your accident, your compensation could get lowered by the court. What your lawyer needs to prevent is the insurance company’s evidence that you were more liable.
When you speak with our motorcycle accident lawyers, we will look over the details of your case, identify all the responsible parties, and tell you your legal options. If you agree to work with us, we will put our plan into action to get you the most compensation we can.
What to Do After a Motorcycle Accident
The first steps after a motorcycle accident are critical, and you may not be able to do many of them. If you are still mobile, the first thing is to call 911 and check to see if everyone is okay. If 911 isn’t necessary, call the police to get an accident report started.
While you wait for the police, take photos of everything at the scene, including your injuries, the vehicles, and the general area. Speak with the driver and exchange contact and insurance information, then speak with any witnesses and get their view of events. Try to get their contact information as well.
Once the police let you go, get to a doctor as soon as you can for an evaluation. Tell them you were in a motorcycle accident. After you’ve been checked for all your injuries, including hidden ones, call John Foy & Associates to see if you have a case. Our motorcycle accident attorneys in College Park will be glad to help.
Why Call a Lawyer As Soon As Possible?
Once the other insurance company knows their client has caused an accident, they’ll get to work confirming what happened and look for evidence to lower or deny your compensation. Insurance policies dislike paying out as much as they should.
By working with a lawyer right away, you can direct the insurer to speak with the lawyer instead. Once they know you have one, they know they have to play by the rules. You’d be surprised at the number of dirty tricks they have to justify lower compensation amounts.
Most cases end in a settlement because they know that with a lawyer’s help, they could lose far more money than they want. You’ll get your settlement check faster. If they decide not to cooperate, we’re not afraid to go to court on your behalf.

Deadlines for Filing Claims in Georgia
Georgia has a deadline for filing personal injury claims, like motorcycle accidents, of two years. You must get your case started before then. You may not speak with a lawyer for several weeks because of your injuries, but there should still be time to start your case.
If it looks like you will be in the hospital for some time, a member of your family can consult with us to get some basic advice. Potentially, they could serve as a representative with your permission while you recover.
If you go beyond the statute of limitations set forth in Ga. Code § 9-3-33, the court will deny your case. This is another reason to work with a motorcycle accident attorney as soon as possible after you’ve been hurt. Don’t wait until it’s too late.
