What to Do After a Bus Accident
There are some things you can do to preserve your health and your compensation after a bus accident. The first thing to do is stay at the scene, remain calm, and call 911 to summon emergency responders.
Next, if you can, start documenting the accident scene for your case. Take photos and videos of what has happened to you and the vehicles. Try to get the contact information of all involved parties and witnesses as well. Our investigative team can follow up with them.
Finally, get a medical evaluation as soon as possible after your accident. Once you’ve been assessed for injury, that’s the time to call a bus accident lawyer. If an insurance company approaches you before then, do not give a statement or sign paperwork without discussing it with your lawyer.
The Question of Liability in Bus Accidents
The top priority of your bus accident lawyer in College Park is to determine who is liable for your accident. That’s the first step in any accident case. Without knowing who was at fault, we won’t know whose insurance we’ll need to work with, nor the strategy we’ll need to use.
Bus accidents can have many parties with liability. The driver is certainly one, but the party who owns and operates the bus company can also share liability. This could be a charter bus company, a school district, or even the Georgia Department of Transportation.
There may also be third parties involved that could be the true responsible party, like another driver or even another passenger. We will hold accountable all parties involved to maximize our chances of success. We are not afraid of pursuing claims against government agencies and school systems, either.
What Is My Bus Accident Claim Worth?
Since there are so many variables to accident cases, it’s difficult to estimate how much your case is worth. Some factors include your injuries and prognosis, the kind of bus accident, and your life circumstances.
We can say that there are certain categories of damages you could be eligible for, and we will work to find the evidence to make them possible for compensation. This includes economic damages like lost wages and and all medical expenses, and many kinds of non-economic damages.
Non-economic damages are things like pain and suffering or disfigurement. These don’t have a specific dollar amount, but the law agrees you can receive compensation for them. Part of our skill as bus accident lawyers is to advocate on your behalf for these damages.
Atlanta Roots, Nationwide Reach.
Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
What Evidence Will You Look for to Prove Fault?
Some of the evidence we’ll need to prove fault and claim compensation were discussed above, like taking photos of the scene and speaking with police. There are other forms that our investigators will look for to build your case, such as:
- Dash cams
- Forensic evidence
- DUI results
- Medical recommendations from your physician
- Evidence from accident reconstruction
- Witness testimony
We need to prove that the responsible party had a duty of care toward you, breached it, and caused your injury. If we can do that, then you have a case, and we can proceed with calculating your damages. If you were a passenger on a bus in a crash, odds are high that these will be easy to prove.
