What do You Need to Do If You Are in an Uber Accident in Cumming?

When a short Uber ride turns into a chaotic and unexpected accident, you should act as quickly as you can by following a few simple steps and tips while at the scene and the days following the crash. Knowing what to do if you are in an Uber accident can help you make sure you do not give up your rights and make serious errors that could jeopardize the recovery of any losses you incur.

Call the Police and Medical Services After an Uber Crash

Uber drivers might be worried about the repercussions of the police arriving at the scene of a crash, but it is a necessity. Insist on calling the police. Do not agree to leave the scene until the police and EMS arrive. If you have injuries, get medical help by EMS and if they suggest you are transported to the hospital, follow their recommendation.

Collect Evidence While at the Scene

Nowadays, it is relatively simple to gather vital evidence while at the scene of an Uber accident. Grab your mobile phone to snap a few photographs and videos of the scene. Record images of the position of the vehicles, visible damage to cars and property, any visible injuries you may have, and any other information or evidence you think might have an impact on your case.

Do Not Speak to Any Insurance Representatives

Your Uber driver is under an obligation to report the accident to Uber through the rideshare application. You may get a call from the insurance company before you even have a chance to get back home.

If another driver is involved in the collision, you may also get a call from their insurer. Do not speak to any insurance company, you must first contact an attorney to represent you in the case. What you say to an insurer can be used in the case to reduce the compensation they may have to pay or even manipulated by the insurer to show that you were somehow negligent as the rideshare passenger.

Hire a Cumming Uber Accident Attorney

As soon as your injuries are stable and you are able to hold a conversation, pick up the phone and contact a Cumming Uber accident lawyer. An attorney that represents Uber accident victims will offer free consultations to discuss the facts of your case and how they may be able to help you. Once you hire an attorney, they will then manage your case, your claim and begin to contact the other parties involved on your behalf, including the insurance companies.

Who Will Pay for Your Losses After an Uber Accident?

Uber accidents are tricky. The rideshare driver’s use of the application is critical to the ability of a victim to seek compensation through Uber’s insurance coverage. Any accident that happens while the rideshare application is on and active while either waiting for a ride request or while on the way to pick up or transport passengers to their destination will trigger Uber insurance coverage.

However, any accident that happens while the rideshare driver has the application off will not be covered by Uber insurance but rather the driver’s personal car insurance when their negligence is the cause of the collision. This is not common when the victim of a crash is a rideshare passenger as the ride is part of the rideshare service. There can be confusion, however, when the victim of an Uber accident is another vehicle occupant and they are not sure whether the driver was working with the application when the collision occurred.

Insurance Coverage Policy Limits for Uber Accident Victims

Coverage limitations offered by Uber when their insurance coverage applies as follows:

• When the Uber application is on but there is no active request – $50k per person/$100k per accident for bodily injury coverage and $25k per accident for property damage
• When there is an active Uber ride request – $1 million in third-party vehicle liability coverage
• If the application is off, Uber will not provide coverage

Damages in a Cumming Uber Collision

As a victim of an Uber motor vehicle accident, you have certain damages you can seek compensation for. The amount of monetary compensation you will be eligible for through an insurance claim or potential lawsuit will depend on how serious your injuries are and what impact the injuries and the accident has on your life.
