Moped Accidents Can Result in Serious Damages and Injuries
Think about how unprotected moped riders are. Compared to a standard truck or passenger vehicle, the likelihood of severe damages or injury is substantially higher. In most cases, the occupants of cars are more likely to come out unscathed compared to moped riders.
You can sustain injuries that leave you with damages such as:
- Loss of consortium
- Loss of enjoyment of life
- Wrongful death
- Paralysis, disability, or disfigurement
- Pain and suffering
- Mental anguish
- Large medical expenses
- Vehicle repairs or replacements
The Smyrna moped accident lawyers at our law firm will help you build a strong case and file a claim. You don’t have to go through this legal battle alone.
Punitive Damages in Georgia
The Official Code of Georgia Annotated (OCGA) 51-12-5.1 allows personal injury victims to receive an additional reward for punitive damages. Punitive damages act as a punishment to the responsible party of an accident if their actions were:
- Malicious
- Done with the intent to harm others
- Fraudulent
- Extremely negligent
Not all cases will qualify to receive a reward for punitive damages. However, for example, if a drunk driver caused your moped accident, then you may qualify. If we feel as though your case can receive an extra reward on top of your settlement, our lawyers will fully pursue those damages.
Let Our Moped Accident Attorneys Help You
You may wonder what our lawyers will do for you after a moped accident. For starters, you shouldn’t expect the defense or the insurance company to just let things go easily. They’re going to put up a fight during negotiations or at trial against your claims for a settlement.
Don’t underestimate the legal knowledge, power, and resources that large insurance companies have. If you don’t have strong legal representation, you will be fighting an uphill battle that seems impossible to win.
Our lawyers will help you establish the fault of the driver responsible for your accident by showing:
- That the driver needed to uphold a duty of care.
- Through negligent actions, the driver did not uphold this duty.
- Because of their failure, an accident occurred.
- Your injuries and resulting damages are a direct result of that accident.
We will help you file your claim, organize your evidence, consult with experts, get witness testimony, retain all of your police, financial, and medical records, and help you understand all aspects of the case you have.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Insurance Companies Will Get You to Settle for Less
Don’t trust the insurance companies. They have many different tactics to try and get you to settle for less, either intentionally or unintentionally. When an insurance adjuster calls you, try to avoid speaking to them until you’ve consulted with one of our moped accident attorneys first.
Insurance companies are businesses. They’re not trying to offer you a settlement in your favor. They are trying to protect their own interests. You shouldn’t be eager to take any offer they give you. Avoid signing any papers, and don’t be persuaded by their concern.
You Have Two Years to File a Claim
The Georgia Code has a statute of limitations for personal injury claims. You have two years to file, or you lose out on your chance to receive compensation. Don’t wait too long to get started building a strong case.
There shouldn’t be a rush to file so quickly, either. While this may seem counterintuitive, rushing to file quickly can actually be a detriment to your claim. If you file your claim and settle too fast, you may miss out on additional compensation for additional damages that may arise later on.
Always wait until you’re fully treated, and you have accounted for all of your damages. Taking the time to start building a solid case early makes it much easier to win a settlement when it comes time to negotiate.
