Workers’ Compensation Benefits in Georgia
In Georgia, state law mandates that most employers with three or more employees provide Workers’ Compensation coverage. This type of insurance offers medical and wage benefits to employees who experience work-related injuries or illnesses. Benefits may include
- Medical Care: Coverage for all authorized and necessary medical treatment related to the injury or illness, provided by an approved healthcare provider.
- Wage Replacement: Temporary income benefits equal to two-thirds of the injured worker’s average weekly wage, capped at the state-mandated maximum.
- Permanent Disability Benefits: Compensation for employees who suffer a permanent partial or total disability as a result of a work-related injury or illness.
- Death Benefits: Financial support for surviving dependents, including funeral expenses and weekly income benefits, in the event of a fatal workplace incident.
If you’re injured on the job, Workers’ Compensation is typically your exclusive source of medical care and financial support. In most cases, you are legally barred from suing your employer. Our Savannah workers’ compensation lawyers can help you understand your rights.
How Our Attorneys Can Help
Our experienced attorneys will guide you through each step, from filing your initial claim to managing any appeals. We’ll ensure you understand what’s ahead and how to prepare for it.
While every case is different, some of the things our construction accident attorneys in Savannah may do include:
- Gather and Present Evidence: Our team will help collect medical records, witness statements, and other critical documentation to build a solid case that supports your claim.
- Help You File Your Claim Correctly: Mistakes or missed deadlines can jeopardize your claim. Our attorneys will ensure all paperwork is complete, accurate, and submitted to the Georgia State Board of Workers’ Compensation within the required timeframes.
- Avoid Common Pitfalls: Navigating the system alone can lead to avoidable mistakes. Our lawyers can help you steer clear of errors that could delay or reduce your benefits.
- Handle Communications with the Insurance Company: We can speak directly with the insurance company on your behalf so that you can focus on healing.
- Negotiate for the Benefits You Deserve: If your claim is undervalued, our lawyers can negotiate with the insurance provider to seek full and fair compensation.
- Assist with Appeals: If your claim is denied, we can help you understand why and represent you through the appeal process to fight for your benefits.
- Represent You in Hearings and Legal Proceedings: Should your case go before a judge or administrative hearing, your attorneys will advocate for you and present your case professionally and effectively.
What to Do if You are Injured in a Construction Accident
If you’re injured on the job, following the right steps can greatly improve your chances of a successful workers’ compensation claim. First, seek medical care from a doctor within your employer’s approved panel to ensure you receive proper treatment.
Report your injury to your employer as soon as possible, even though you have up to 30 days to do so, to prevent any complications. Keep detailed records of your medical expenses, time missed from work, and any other injury-related costs.
Finally, it is smart to get legal help when you are dealing with insurance companies, especially if your claim has already been denied. Our Savannah construction accident lawyers can protect your rights and guide you through the complex claims process.
