Who’s at Fault for a FedEx Truck Accident

FedEx accidents often happen when a driver is careless. The legal term for carelessness with accident cases is “negligence.” In Georgia, employers are usually responsible for their employees’ negligence under the Official Code of Georgia Annotated (OCGA) §51-2-2.

FedEx is usually accountable for a driver’s actions while on the job. However, always get the driver’s name after the accident. You will need to know the identity of the person when you begin filing your claim.

Besides the driver, other at-fault parties can be:

• The FedEx company
• A vehicle manufacturer
• A government agency
• A mechanic or repair shop

FedEx might increase the chance of a driver having an accident. With online shopping, delivery services often have strict deadlines to meet. Drivers might feel pressure to cut corners and drive recklessly to deliver faster, putting everyone at risk.

Some FedEx truck accidents happen because of faulty maintenance or vehicle defects. Other times, road conditions might contribute to the accident. So, you could have a claim against other companies or the government in certain situations.

As you can see, truck accident claims are often complicated. It’s best to consult with an experienced lawyer before assuming your options.

FedEx Trucks and Independent Contractor Drivers

Some FedEx drivers work as independent contractors. Unlike FedEx employees, contractors don’t have the same protections. If a contracted driver gets into an accident, the company might not be liable.

An independent contractor driver could be personally at fault for an accident. If so, you would need to file an insurance claim or lawsuit against the driver. Or, both the driver and FedEx might be partially responsible for your damages.

Truck accident claims are more complicated than other auto accidents because:

• Multiple parties could be at fault
• Damages tend to be more severe
• The accident could involve several vehicles
• Negligence is often harder to prove

Companies like FedEx are also huge and powerful. They will have enormous insurance policies to handle accidents. When you file an insurance claim, the insurance company will be ready. They’ll look for ways to reduce what they pay.

Thankfully, you can level the playing field by working with a Sandy Springs FedEx truck accident lawyer. If the insurance company sees you have an attorney, they’re more likely to offer a fairer settlement.

An experienced lawyer will know how to negotiate for what you deserve. At John Foy & Associates, we’ve been helping accident victims in this way for over 20 years. To get a free consultation today, call (404) 400-4000.

Gathering Evidence for a FedEx Truck Accident Claim

Commercial trucks contain “black box” data that can tell you about the truck’s route. You can also gather information about the accident location and who was driving. Other significant evidence from your accident includes:

• Pictures from the scene
• Contact and insurance information from the driver
• Eyewitness contact information
• Security camera or dashcam footage
• Copies of your medical bills and other damages

If your case goes to court, the jury might award more when a large company is involved (versus a single driver). But most accident claims end with an insurance settlement. You probably won’t need to go to trial, but a lawyer will be there to help if you do.

However, you will need to have a strong personal injury case. It’s best to contact a lawyer today who can start gathering information for you.

FedEx Truck Accident Damages

Large delivery trucks can cause a lot of damage during an accident. Trucks are especially dangerous when they collide with passenger vehicles. Plus, truck cargo might fall out and injure victims further.

If you or a loved one were injured, the aftermath could derail your life. But you shouldn’t have to bear the costs of someone else’s negligence. You probably have the right to claim damages like:

• Medical bills
• Medication costs
• Vehicle repairs
• Pain and suffering
• Lost wages
• Emotional trauma

You will need to know all of your accident damages before filing a case. Truck accidents often lead to severe injuries. You might need long-term treatment. In some cases, accident injuries can lead to disabilities.

Not all damages are physical. FedEx truck accidents can leave someone with emotional trauma for many years, too. Talk to your lawyer about how the accident has affected different areas of your life.

Some truck accidents result in deaths. If you lost a loved one in a FedEx accident, you could have a wrongful death claim. Talk to a trusted truck accident lawyer about whether or not your family can file a claim for compensation.
