Proving Liability in a FedEx Truck Accident
FedEx drivers are either employees or independent contractors. The driver’s work status makes a difference when it comes to who is liable for an accident:
- If an employee causes an accident, the company is usually liable for the damages, according to the Official Code of Georgia Annotated (OCGA) §51-2-2.
- If an independent contractor causes an accident, the driver or the company might be responsible for the damages.
FedEx generally provides liability insurance for contractors and employees. However, proving fault in an accident with a contractor is more difficult. Companies can often avoid liability when a driver is not an employee.
FedEx is usually only liable if they failed in the hiring of a driver. For example, maybe hired a driver who was not fit to drive for them. Or the driver was drunk when they caused the accident.
An experienced lawyer will know how to prove who was at fault. It typically takes an in-depth investigation into what occurred. The driver, FedEx, or another party could be at fault for the accident.
How to Gather Evidence for a Truck Accident Claim
If someone was at fault for your accident, you might file a claim with their insurance company. FedEx carries liability insurance in the case of an accident on the job. However, you won’t automatically get compensation for filing a claim. You’ll need to include proof of fault and your damages.
You can compile evidence to back up your claim by:
- Gathering information from the accident scene
- Pulling “black box” data from the FedEx truck to view the driver’s actions
- Getting a copy of the police accident report
- Keeping copies of all medical bills, receipts, etc. from your injuries
Also, contact a Johns Creek FedEx truck accident lawyer to help with all of the above. A lawyer can determine all of your damages and make sure you file within the deadline.
Truck accident claims are some of the most complicated. It’s best to work with a professional from the beginning to keep you on track. They can help you obtain information that’s difficult to get on your own.
How to Handle the Insurance Companies
Insurance companies do not have your best interest in mind. After the accident, it’s important to protect your legal rights. The insurer might use tactics like:
- Downplaying your injuries
- Questioning your damages
- Using something you’ve said against you
- Blaming you for the accident
- Offering you a lowball settlement
Do not accept any fault for the accident. Also, don’t agree to sign anything or give a recorded statement. Instead, call a lawyer who can handle the insurance company for you.

Damages You Can Claim from a FedEx Truck Accident
FedEx trucks are big vehicles. If the driver of one causes an accident, the damages can be severe. When you file a claim, you’ll need to consider any losses you have because of the accident.
There are two main types of damages:
- Economic damages
- Non-economic damages
Economic Damages
Economic damages, also known as special damages, are monetary losses. These damages have a set dollar amount, and you can usually prove them through bills and receipts.
Economic damages include:
- Medical bills from doctor and hospital visits
- Prescription medications for pain relief or treatment of your injuries
- Lost wages from missed work time
- Loss of earning capacity if you have to take on a lower-paying job because of your injuries
- Vehicle repairs to fix or replace your car
You can usually prove these costs through documentation. However, sometimes you need to account for future costs. For example, injuries often have long-term or ongoing treatment needs.
After the accident, see your doctor as soon as possible. Go to all follow-up appointments, and keep up with your treatment. You’ll need to know what future medical costs to expect so that you can include them in your claim.
Non-Economic Damages
Not all damages are monetary. Some are about how the accident has affected your life, such as:
- Physical pain and suffering
- Mental pain and suffering
- Loss of enjoyment of life
- Fear or embarrassment
- Emotional trauma
Talk to your lawyer about how the accident and your injuries impact your life. Your lawyer can use a formula to determine the value of these damages.
If you didn’t cause your accident, you might deserve full compensation. But bringing a case after a FedEx truck accident isn’t easy. It’s best to get started as soon as possible and consult with an experienced lawyer.
