We Will Handle Your Injury Case While You Focus on Recovery

It can be challenging to handle an insurance claim or personal injury lawsuit when you are recovering from injuries. While you focus on your recovery, our team will take care of your entire case. We will:

• Look into the accident and gather evidence: We will examine every detail of the crash and gather evidence (e.g., a police report, witness testimony, the driver’s logbook, truck maintenance records, video footage, etc.).
• Identify liable parties: Multiple individuals or entities could be responsible for your damages. We will list each one and determine their share of liability for the crash.
• Assess the value of your damages: Knowing your case’s value helps you avoid settlements that don’t cover your expenses. We will accurately calculate your losses before seeking a fair settlement.
• Negotiate with insurers: Insurance companies can try to minimize payouts, leaving you with less than you deserve. Our lawyer will protect your interests while seeking a favorable outcome for you.
• File a lawsuit: If we cannot settle your case, we can sue for your recovery in court.

You will also receive case updates so that you are always aware of what is going on. Call or contact us online for a free case evaluation.

Understanding Amazon Delivery Van Accidents in Augusta, GA

Once a commercial vehicle accident happens, there are many issues to consider, including determining who is at fault and which insurance policy you can file a claim against.

Who Can Be Liable in an Augusta Amazon Delivery Van Crash?

Determining liability in an Amazon delivery van accident can be complex. The person liable for the collision could be the driver, Amazon, or another entity. Here’s a breakdown of those who can be held accountable:

• Amazon delivery driver: If the driver’s careless or reckless behavior caused the accident, they could be held personally liable. This includes actions like speeding, distracted driving, or running a red light.
• Amazon: The retailer may be vicariously liable if the driver is its employee. If Amazon did not properly vet or train the driver, it could be held liable. It can also bear responsibility if mechanical failure due to poor maintenance of the delivery van caused the crash.
• Third parties: If a defect in the van contributed to the accident, the vehicle manufacturer could be held liable.
• Other drivers: If another driver’s actions caused or contributed to the accident, they could be held partially or fully responsible.

We Must Show How Amazon Is Responsible for the Crash

To establish liability, our Amazon delivery van accident lawyer in Augusta, GA, must be able to use the evidence in the crash to prove the four elements of negligence, which include:

• Duty of care: The driver or Amazon had a duty to act responsibly and avoid causing harm.
• Breach of duty: The driver or Amazon violated the duty of care through negligent actions or omissions.
• Causation: The negligent party’s breach of duty directly caused the accident and your injuries.
• Damages: You suffered damages from the accident, such as healthcare expenses, lost income, and pain and suffering.

Insurance Coverage for Amazon Delivery Services

Determining which insurance covers an Amazon delivery van accident can be complex. We can identify applicable policies and their coverage limits, file your claim, and communicate with the insurer.

Amazon uses delivery service partners (DSPs) and independent contractors. Each type of driver has different insurance policies affecting your claim process. We will ensure your claim is filed with the correct insurer by identifying whether the driver is a DSP or an independent contractor.

Our Amazon delivery accident attorney will contact insurance companies on your behalf. We also recommend keeping detailed records of all communications with insurance companies and Amazon.

Damages You Can Seek After an Amazon Delivery Van Accident

Our Amazon delivery van crash attorneys in Augusta will decide how much compensation to pursue. Your financial award will be based on several factors, including the severity of your injuries and recovery time.

Typical damages in these cases include:

• Medical expenses (including for emergency care and hospital services)
• Lost income due to missed time at work
• Lost earning ability (if your injuries affect your ability to work in the future)
• Pain and suffering (physical and mental)
• Vehicle damage
• Other related damages

Our Augusta catastrophic injury lawyers can lead your case to recover damages for extended care for severe wounds, such as traumatic brain injury (TBI) or spinal cord damage.

Injured parties in these cases can recover higher compensation because their recovery is expected to last a long time or permanently, which means high medical bills, among other costs.

Wrongful Death Damages

Our Augusta wrongful death lawyer can take legal action if your loved one did not survive the accident. Typical recoverable damages in these cases include compensation for your loved one’s medical expenses, funeral and burial costs, lost expected income, and other losses.

During a free case review, we can tell you who can file a wrongful death lawsuit in Georgia and the difference between a wrongful death action and a survival action. Call us today to talk with a member of our legal team.

Case Filing Deadlines for Personal Injury Cases in Georgia

In Georgia, injured parties have time limits to file personal injury or wrongful death lawsuits. For personal injury cases, the statute of limitations in Georgia is generally two years from the date of the injury, per state law.

In wrongful death cases, where a loved one has died due to someone else’s negligence or intentional act, the deadline is also two years from the date of death. This allows the decedent’s family or estate time to seek compensation for their loss.

Our Augusta personal injury team must meet these deadlines, or you will lose your right to pursue your case. Call us today to learn more about your case’s deadline and how much time we have to build it.
