We Will Determine Whose Insurance Should Cover Your Losses
Before our personal injury lawyers in Macon can file your claim or lawsuit, we must first figure out which insurance companies to file your claim with. We must also determine if the driver was a delivery service partner (DSP) or an independent contractor, such as Amazon Flex.
Various insurance policies cover these individuals, which can affect how your claim is handled. Keep detailed records about the accident and any communications you have with an insurance company. We will contact them on your behalf and pursue the next steps.
How Other Parties Could Be Responsible for Your Losses
You might be able to pursue compensation from other individuals or entities besides the delivery van’s driver. These can be:
- Amazon, if the online retailer was negligent in failing to maintain its vehicles or if it hired unqualified drivers.
- A manufacturer, if a defective vehicle or vehicle part caused the crash.
- A cargo loading company, if the truck’s load wasn’t secured properly or exceeded the legal limit.
- A government entity, if a road’s condition contributed to the crash or a traffic signal or sign was not working.
- Another driver or road user, such as a motorist or pedestrian.
It’s not always apparent who should compensate accident victims because not all parties are at the scene when a crash occurs. We will identify all parties and determine their role in the accident and what their financial responsibility is.
Recoverable Damages in an Amazon Delivery Van Accident
You can recover various damages after an Amazon delivery van in Macon. Generally, these losses fall into two categories: economic and non-economic.
The severity of your injuries, expected recovery time, and other factors will determine how much compensation you can request. We will review all your losses, including the following:
Economic Damages
- Medical expenses: This includes emergency care, hospital treatment, medication, surgeries, and any other treatments. If you have long-term injuries, you could receive compensation for ongoing medical care.
- Lost wages: If your injuries prevent you from working, you can recover the income you would have earned during your recovery period.
- Loss of earning capacity: If your injuries result in a long-term or permanent disability that affects your ability to work, you can seek compensation for your reduced earning capacity.
- Property damage: This includes the cost to repair or replace your vehicle and any other personal property damaged in the accident.
- Other expenses: These include your transportation costs to medical appointments, home modifications, and other adjustments needed to accommodate your injuries.
Non-Economic Damages
- Pain and suffering: Compensation for physical pain, mental anguish, and emotional distress resulting from the accident and your injuries.
- Emotional distress: This includes anxiety, depression, post-traumatic stress disorder (PTSD), and other mental health conditions you experienced after the accident.
- Loss of enjoyment of life: If your injuries prevent you from participating in activities and hobbies you once enjoyed, you could recover compensation for this loss.
- Loss of consortium: This refers to the impact of your injuries on your relationship with your spouse or family, including the loss of companionship, affection, and support.
Sometimes, these accidents cause very serious injuries, such as internal organ damage or traumatic brain injury (TBI). If this is your situation, our Macon catastrophic injury lawyer can review your needs and decide how much monetary compensation you need to request for your long-term medical care.
