How FedEx Truck Accidents Happen
FedEx truck accidents often happen because a driver is at fault. FedEx truck drivers are commercial drivers, which means they have a higher duty of care. If a driver is careless, they might be liable for accident damages.
Reasons a driver causes an accident include:
- Failing to yield
- Running a red light or stop sign
- Speeding
- Reckless driving
- Driving under the influence (DUI)
- Poorly-secured packages
- Unsafe lane changes
- Driving while distracted
FedEx drivers often have strict deadlines, especially during high-delivery times of the year. A driver might speed or take other reckless actions to make deliveries faster. They could also hit a pedestrian, a cyclist, or someone else on neighborhood streets.
If a driver caused your accident, you have rights. A Roswell personal injury lawyer can help you determine who is liable and if you have a case to seek compensation.
Liability in a FedEx Truck Accident
Some FedEx truck drivers are independent contractors. If one of these drivers causes an accident, the driver doesn’t have the same protection as an employee. The driver might be responsible for the accident instead of FedEx.
If the driver is an employee, FedEx is probably liable for their actions. You will need to know the driver’s worker status before filing your claim.
The at-fault party’s insurance company usually covers accidents. The first step is usually to file an insurance claim. If you can get a fair settlement offer, that might cover your full accident damages.
Damages You Can Claim from a FedEx Accident
If someone causes an accident with injuries in Roswell, the injured party has rights. If you were not at fault for the accident, you can seek financial recovery. According to the Official Code of Georgia Annotated (OCGA) §51-1-6, you can seek damages after someone breaches their legal duty.
All drivers in Georgia have a duty to drive carefully. That includes acting in a way that doesn’t cause accidents. If a FedEx driver causes an accident, they or the FedEx company is probably liable.
Common accident damages include:
- Medical bills
- Prescription medications
- Lost wages
- Loss of earning opportunity
- Vehicle repair or replacement costs
- Pain and suffering damages
- Loss of enjoyment of life
- Wrongful death
Be careful to document all of your accident damages. When you file a claim, you’ll need to outline each loss you have. Talk to a Roswell FedEx truck accident lawyer to get help with this.

Don’t Take the First Settlement Offer
Companies like FedEx carry large auto insurance policies. If an accident happens, you can probably file a claim with the insurer. However, be careful if you communicate with the insurance company.
Most insurers will offer a quick settlement after an accident. This might seem like a nice deal, but the first offer is always a lowball. It probably won’t even come close to covering your total damages.
Before accepting anything from the insurance company, contact a lawyer. At the very least, you can learn your options during a free consultation. A lawyer can help you know what a fair settlement should look like.
Common FedEx Truck Accident Injuries
FedEx delivery trucks are large vehicles. They also contain heavy packages that can shift and fall during transport. If a FedEx truck gets into an accident, the damages are often severe. That means serious injuries that can become fatal.
After an accident, you might have injuries like:
- Broken bones
- Traumatic brain injuries (TBI)
- Spinal cord injuries
- Neck and shoulder injuries, such as whiplash
- Lacerations
- Severe bruising
Some accident injuries are serious enough to cause death. If a loved one died in an accident, a family member can bring a wrongful death claim. A wrongful death claim can seek compensation for funeral costs, burial costs, and more.
Document your injuries as fully as possible after your accident. Even if you feel okay, have a doctor check you for any damage. Some injuries take time to fully show up. Also, you’ll want to know about any future treatment needs.
Your insurance claim should account for all your losses from the accident. If you or a loved one were hurt in a FedEx accident, contact a lawyer today. Your lawyer can determine your damages and help you build a strong claim. If you need to take your case to court, your lawyer will be there for each step.
