Knowing Who’s Responsible for Your Rental Car Accident Damages

After a car accident in Georgia, the at-fault party is responsible for the costs. If you were injured, you can seek compensation for your damages, according to the Official Code of Georgia Annotated (OCGA) §51-12-4.

Liability is not always apparent. You’ll need to examine whose actions led to your accident. Thankfully, an experienced lawyer can help.

The at-fault party in a rental car accident is usually one of the following.

The Other Driver

In most car accidents, one or more drivers are at fault. The same often goes for a rental car accident.

When someone rents a car, the company typically avoids liability. The driver might purchase additional insurance through the company or use their own insurance. Either way, an insurance policy or the driver is usually responsible for an accident.

If you were renting a car or were hit by a rental car driver, talk to a lawyer. The other driver might be liable for the costs of your accident. You can seek compensation through an insurance claim.

The Rental Car Company

Rental car companies must ensure their vehicles are safe to drive. If a rental car is unsafe and causes an accident, the company could be at fault. The company might also be liable if they rented to an unfit driver.

A Vehicle Manufacturer

Some accidents happen because of car defects. If a part is faulty or defective, it can lead to an accident. The manufacturer of the car might be responsible for the damage the accident caused.

When you work with John Foy & Associates, we’ll investigate the cause of your accident. We leave no stone unturned when we dive into the details. We’re also not afraid to “Strong-Arm” the insurance companies who resist paying what you deserve.

Common Causes of Rental Car Accidents

Rental car accidents often happen for the same reasons as other accidents. If a driver was at fault, the accident might happen because of:

• Drunk driving
• Distracted driving
• Reckless or aggressive driving
• Speeding
• Failure to yield

As mentioned above, defects or poor rental practices might also be at fault. Also, every accident is different. It can be confusing when considering which insurance company should cover the costs.

Our team can determine who is at fault and what compensation you deserve. We make sure you understand your legal options while fighting for your rights.

Actions to Take After a Rental Car Accident

It’s best to contact a personal injury lawyer as soon as possible after your accident. Your lawyer can start collecting information and building your case. However, there are also actions you can take to support your claim.

Here are some steps we recommend doing as soon as you can after the collision.

Call the Police

Always report an accident with injuries or damage to the police. Make sure responding officers create an accident report. This report will be crucial to your claim.

Document the Scene

If you’re well enough to do so, document the accident scene:

• Take pictures of your injuries and vehicle damage.
• Photograph many pictures of the scene, including skid marks or other details.
• Look for any eyewitnesses. Ask for their names and contact information.

If the rental car driver caused your accident, ask what rental company they use. Get the contact information for that company, and ask about insurance coverage on the vehicle.

After you leave the scene, document what you can. Save all medical bills and records. Take notes on how the accident and your injuries affect you.

Get Medical Treatment

If you need emergency treatment at the scene, call 9-1-1. Don’t avoid getting the help you need.

If you don’t receive treatment at the scene, see a doctor as soon as possible. If you wait too long, the insurance company will use it against you. It can be difficult to prove that your injuries resulted from the accident.

Be Careful What You Say

The other driver’s insurance company might contact you after the accident. If so, be careful. In fact, avoid talking to the insurer at all if you can. Wait until you have a lawyer who can handle the insurer for you.

Insurance companies know what they’re doing when handling an accident claim. The adjuster will look for ways to reduce what they have to pay you; it’s their job. Instead of taking chances, contact a lawyer who can help protect your rights.

Talk to an Experienced Lawyer

An experienced rental car accident lawyer can help with all of the above. Reach out to a lawyer as soon as possible after your accident.

At the very least, schedule a free consultation to determine your legal options. That way, you can move forward knowing what you deserve—and how to pursue it.
