Did you suffer catastrophic injuries due to someone else’s negligence? Do you find yourself questioning your next steps and wondering how to protect yourself and your right to compensation? Trying to handle your claim on your own can prove confusing or, worse, cause you to accept a lower compensation offer than you really deserve.
At John Foy, we help victims of personal injury lawyers in Austell pursue the compensation they deserve.
Understanding Catastrophic Injuries in Austell
Catastrophic injuries include any injury that poses significant, ongoing complications for the victim, including those that interfere with the victim’s ability to work or otherwise generate gainful income. Catastrophic injuries may include:
- Loss of one of the senses (vision or hearing)
- Spinal cord injuries
- Moderate to severe traumatic brain injury
- Amputation of a limb
Recovering Compensation After a Catastrophic Injury in Austell
Following a catastrophic injury in Austell, you have the right to pursue compensation through a personal injury claim. Working with a catastrophic injury lawyer in Austell can make it easier to determine who bears liability for your catastrophic injuries and what compensation you may deserve.
At John Foy, we cannot guarantee the compensation you will recover after your accident. However, because catastrophic injuries often carry hefty medical bills and usually involve long-term limitations for the victim, you may deserve substantial compensation–and we can help give you a better idea of how much.
Evaluating Your Medical Costs
Catastrophic injuries frequently mean extreme medical bills. You may have to undergo multiple surgeries and procedures, need durable medical equipment to get around, or have frequent appointments with specialists who aim to help you manage your case and give you a better idea of your future prognosis.
In addition to your immediate medical bills, you may also have future anticipated medical bills related to your injuries. For example, a limb amputee who chooses to use a prosthetic may need to replace the prosthesis every 3-5 years, depending on overall wear and tear. As part of your claim, talk to your doctors and your Austell catastrophic injury lawyer about those potential future medical costs and what they may look like.
Calculating Your Loss of Income
Catastrophic injuries frequently prevent the victim from working in their preferred field, or even make it impossible for them to work altogether. For example, if you suffer a traumatic brain injury, it could prevent you from easily managing your own schedule or participating in creative tasks.
You may have a hard time dealing with customers or handling any type of emotional input, which can make a customer service position very difficult. If your injuries prevent you from going back to your former job or industry, you may have the right to claim lost earning potential: compensation for the income you could have had, but which your injuries prevent.
In some cases, you may suffer catastrophic injuries that do not prevent you from working entirely, but which lead to a long period of time out of work. Frequently, victims of those injuries have a long hospitalization or road to recovery while they learn to cope with their new limitations and determine what comes next. Talk to your lawyer about how much time you have lost at work and how that lost time impacts your right to file a claim.
Determining Compensation for Pain and Suffering
Catastrophic injuries do not only cause financial losses in your life. They can leave you in immense physical pain and lead to emotional devastation, particularly if you suffer a permanent loss of independence or have a hard time participating in the activities that once brought you joy after your injuries. While that suffering does not cause direct financial damage, it does have a significant impact on every area of your life. A lawyer can help break down how you might include that pain and suffering as part of your catastrophic injury claim.
Who Bears Liability for Catastrophic Injuries in Austell?
Talking to a lawyer may be the best way to determine who bears liability for your catastrophic accident, since your accident may involve multiple parties who all share liability for your injuries. A lawyer will ask several questions about the parties that might have contributed to your accident.
- Who bore a duty of care to you when the accident occurred? For example, premises owners bear a duty of care to their guests, and drivers bear a duty of care to others on the road.
- How did the liable party violate that duty of care? In short, what act of negligence or carelessness did the liable party commit? Failure to make needed repairs? Ignoring the rules of the road?
- How did that violation lead to your accident?
- What injuries did you sustain as a direct result of that party’s negligence?
Finding the party liable for your accident and your injuries can allow you to pursue compensation through a personal injury claim.
