How Negligence and Liability Works in a Slip and Fall Accident at California Pizza Kitchen
In Georgia, restaurants like California Pizza Kitchen has a legal duty to maintain safe premises for customers who come onto their property. That means managers and employees must be careful to watch for, identify, and clean up or fix potential injury hazards on the property. If workers are not careful to do this and someone gets injured as a result, the restaurant is negligent in the accident and likely liable.
When a store is negligent, it means they’ve failed to uphold their legal duty to keep the premises safe and prevent harm. Negligent parties in Georgia are responsible for the financial costs of injury accidents they cause. So, if employees at a California Pizza Kitchen were negligent in your slip and fall accident there, you can file a claim for compensation.
Damages You Can Include in Your Slip and Fall Accident Claim
There are two main types of damages that are included in a slip and fall accident claim in Georgia:
- Economic damages (also known as special damages)
- Non-economic damages (also known as general damages)
Economic damages refer to compensation for monetary losses from your accident like:
- Medical bills
- Future medical costs
- Physical therapy
- Lost wages
- Lost earning capacity
- Property damage
- Vocational rehabilitation
These damages can be demonstrated through dollar amounts. They’re the easiest to prove and include in your injury claim. That being said, some damages may require complicated calculations, such as future medical care that you will need but have not yet received.
The second type of damages, non-economic damages, are more subjective and do not have a set value. Examples of non-economic damages include:
- Pain and suffering
- Emotional anguish
- Loss of enjoyment of life
- Humiliation or embarrassment
- Fear
These non-economic damages are meant to account for how the accident and your injuries have impacted your life. To be eligible for non-economic damages, they must directly result from a physical injury.
Thankfully, a Georgia slip and fall accident lawyer can help you determine the full value of all your damages from an accident at California Pizza Kitchen. The goal is to get you the full compensation for your costs and other damages.

After you file your injury claim, California Pizza Kitchen’s insurance company might respond very soon with a settlement offer. This number will almost certainly be a lowball settlement that doesn’t come close to covering your full expenses.
Before accepting any money, signing anything, or giving any recorded statements to the insurance company, call an experienced slip and fall accident lawyer. Your lawyer can make sure you are pursuing a settlement amount that is actually fair to you.
