How Slip and Fall Hazards Happen at Bed Bath Beyond in Georgia
Bed Bath Beyond stores frequently have a lot of customers and employees inside at one time. They also carry a lot of different types of merchandise in various sizes and textures.
When things are busy, this can make the interior very crowded and hard to navigate. Items can become disorganized, fall, or get shifted into the aisles where slip and fall accidents can happen easily. Shoppers may also spill liquids from inside the store or outside food or drinks onto the floors, causing an instant dangerous slip and fall hazard.
If employees are not meticulous about cleaning and watching out for potential hazards, accidents can happen anywhere and at any time. In an instant, a customer’s life can change from the impact of slipping and falling inside a Bed Bath Beyond. They’ll find themselves with painful, costly injuries, missed work time, and more to deal with—at no fault of their own.
Types of Slip and Fall Accident Hazards in Bed Bath Beyond
There are many ways someone could slip and fall in one of these stores, but here are some of the most common hazards we see:
- Merchandise or signs that have been left out or fallen on the floors or in the aisles
- Loose flooring or rugs
- Broken racks or shelving
- Slippery floors from spills or mopping without a warning sign
- Poor lighting inside the store
- Snow, ice, or rain puddles that haven’t been cleaned up near the entrance or in the parking lots
Ways Bed Bath Beyond May Fight Your Claim
If the store did not uphold its duty to maintain safe premises (as outlined in Georgia Code section 51-3-1) and breach of that duty led to your slip and fall accident, you have a right to file an insurance claim. The insurance company for Bed Bath Beyond would then examine and respond to your claim.
Unfortunately, most injury victims find the insurance company either deny their claim or offer them a tiny settlement amount (such as a few hundred dollars) that doesn’t come close to covering their damages.
In addition, both the store and the insurance company will look for ways to shirk responsibility for the fall. They might do this by:
- Claiming they had no way of knowing about the hazard that caused your accident
- Blaming you for the slip and fall accident
- Saying your injuries were a result of a prior injury or condition, not the accident in their store
When this happens, contact a Bed Bath Beyond slip and fall accident lawyer to help you gather strong evidence to support your claim.
Six Things to Do After a Slip and Fall Accident in a Georgia HomeGoods Store
The moments after any slip and fall accident are crucial, especially when it happens in a store like Bed Bath Beyond. You can begin compiling information for your claim right away. Here are some things you can do to legally protect yourself.
1. Take Pictures
If you are able, right after the accident occurs, use your phone or a camera to take pictures of the accident scene, the dangerous condition that caused your fall, and your injuries. Get a clear picture of the full scope of what happened. You might also take a video and explain what just occurred.
Slip and fall accident scenes can be cleaned up quickly, so taking pictures will preserve what happened even if the actual scene changes. This can be powerful evidence in your case.
2. Report the Accident
Don’t leave the store without letting a manager know that you fell and were injured. If you can’t find a manager, ask a store employee to take you to them.
Also, ensure someone in the store makes a written report of the accident, and ask for a copy. Get the name and contact information of the manager, as well.
3. Do Not Apologize
It’s very important to watch what you say in the moments after a slip and fall accident. The manager or employees might try to imply you were to blame for your accident. You might also feel inclined to apologize or say you were just “being clumsy.” It’s human nature to say something like this out of politeness, but stand firm.
Stick with the facts. You were injured after slipping and falling because of a hazard in the store. Even if you worry that you were partially to blame, avoid admitting any fault or apologizing until you’ve spoken to a lawyer. Otherwise, something you say might be used against you later.
4. Talk to Witnesses
In stores like Bed Bath Beyond, it’s rare for there not to be other customers around. Chances are, someone else saw your fall or the hazard that caused it.
Talk to any witnesses and ask for their name and contact information. Their testimony may be vital evidence in supporting your slip and fall accident claim.
5. See a Doctor
After you leave the store, see a doctor as soon as possible. Getting treatment is so important for both your own well-being and your insurance claim. If you wait days to see a doctor for your injuries, it will look like they aren’t actually serious—and the insurance company can use it as a reason to deny your claim altogether.
Also, make sure the medical professional you see documents your injuries.
6. Call a Slip and Fall Lawyer
When filing a claim with a large chain like Bed Bath Beyond, you’re almost always better off working with a slip and fall lawyer. They can help you take action quickly and gather what you need to build a strong claim for compensation.
