The Most Important Steps to Take After a Slip and Fall at Waffle House in Georgia

There are certain things you should do after a slip and fall at a restaurant like Waffle House. To have a valid claim for compensation, you’ll need to show that the restaurant employees were negligent in your accident. You’ll also need to document damages and build a strong premises liability claim to file with the restaurant’s insurance company.

To begin building your case right after the accident, here are some of the most important actions to take.

Report Your Slip and Fall Injuries

Be sure to report your accident to the restaurant. If an employee didn’t see you fall, tell them about your accident and ask to be taken to a manager. The manager will likely complete a report on what happened.

Stick with the facts, but avoid apologizing or blaming any of the slip and fall on yourself. This could be used against you later.

Get Photos at the Scene

Picture evidence can help preserve the scene, especially if it is fixed or cleaned up soon after. Use your phone to take pictures of:

• The hazard or dangerous condition that caused your fall
• Your injuries and
• The entire slip and fall accident scene

Pictures can be really helpful for your slip and fall injury claim.

Talk to Witnesses

When a slip and fall happens at a restaurant like Waffle House, chances are good that another patron or employee saw the accident. If anyone else saw you fall, talk to them about what they witnessed. Ask for their name and contact information.

Your slip and fall lawyer will reach out to witnesses later for statements. Having another person mirror what you’re claiming can be really helpful, especially if the restaurant or their insurance company is trying to deny liability in the accident.

See a Doctor

If you have life-threatening injuries, get medical attention right away. Otherwise, it’s best to see a doctor on the same day as your slip and fall accident.

If you wait too long to get medical treatment, the insurance company might try to claim that your medical costs don’t directly result from your accident injuries. They might also try to say you weren’t hurt as badly as you’re claiming.

Document Your Damages

Keep track of all expenses, such as medical bills, medical records, receipts for prescription medications, proof of lost wages, and more. It’s good to keep a folder with this information so it’s all in one place. You’ll need to include this proof of your damages in your premises liability claim.

Your slip and fall lawyer can also help you compile the necessary information to fully show your damages. If you need help obtaining certain documentation, they can help you get it.

Talk to a Waffle House Slip and Fall Lawyer

It’s also best to contact a slip and fall lawyer in Georgia within a day or two of your accident. Be sure to work with someone who has experience working on cases against restaurants like Waffle House. They will know how best to handle claims involving large companies like this.

Most slip and fall lawyers (like John Foy & Associates) do not charge a fee unless they win you money. Then, their lawyer’s fee is simply taken as a portion of the settlement or award they win you. This allows you to get legal representation right away without worrying about additional costs.

Schedule a consultation as soon as you can to get a lawyer on your side from the beginning. This will help increase your chances of a successful case that brings you full compensation for your damages.
