What You Should Do After a Slip and Fall Accident at Victoria’s Secret in Georgia
In Georgia, you have the right to seek compensation after an injury accident someone else caused. Stores in Georgia, including Victoria’s Secret, have a duty to keep their premises safe and prevent harm to customers and visitors. If the store fails in that duty, they are liable in damages (Georgia Code section 51-3-1).
Even though you are the slip and fall victim, the burden is on you to file a personal injury claim for compensation. That also means you will have to demonstrate that:
- The Victoria’s Secret store had a legal duty to you as a customer or visitor.
- The store was negligent and failed in that duty.
- Your damages directly resulted from the store’s negligence in your accident.
You will also need to prove your damages, such as your medical costs, lost wages, any property damage, and any pain and suffering you experience. The following steps will help you do that.
1. Document the Scene
Picture evidence can be incredibly powerful in slip and fall cases. If you are well enough, use your phone to take pictures of the accident scene, your injuries, and the hazard or dangerous condition that caused you to fall.
You might also take a video of the scene and explain what happened. The more you can document, the better. Slip and fall scenes are easy to clean up or change quickly.
2. Talk to Witnesses
Chances are good that someone else either saw you fall or saw the hazard that led to your fall—or both. Victoria’s Secret stores are often fairly crowded with merchandise, store racks, and other people. It would be hard for someone nearby to miss what happened.
Talk to anyone who may have seen your accident, ask what they saw, and get their full name and contact information. Your Victoria’s Secret slip and fall accident and injury lawyer will want to reach out to them later.
3. Report the Accident to Management
Make sure the store knows that your accident happened. Ask an employee to take you to a manager. Do not apologize or admit any blame. Simply tell them that you fell and were injured in their store.
If the manager or an employee makes you feel like the fall was your fault, talk to a lawyer as soon as possible. They are likely trying to reduce their liability, not actually speaking the facts.
4. See a Doctor
As soon as you can after leaving the scene, get your injuries checked out by a doctor. There are two main reasons you should do this:
- It shows the store’s insurance company (who will ultimately be responsible for your damages) that your injuries are serious.
- Slip and fall injuries can easily worsen with time. You will want to get prompt treatment to ensure your condition doesn’t become more severe.
5. Keep Track of All Your Damages
Save all bills, receipts, doctor notes, and other evidence of losses you face because of your slip and fall accident at Victoria’s Secret. You will need these for your slip and fall accident injury claim. It’s a good idea to have one folder where you keep everything.
6. Talk to a Victoria’s Secret Slip and Fall Accident and Injury Lawyer in Georgia
Finally, you will probably need to get a lawyer who focuses on slip and fall accidents at locations like Victoria’s Secret. An attorney can help you with any type of injury case, but they are especially valuable when the accident involves a large store like Victoria’s Secret.
Stores will have their own legal resources at the ready, so having your own lawyer levels the playing field. Thankfully, most personal injury lawyers do not take a fee unless they win you money. At John Foy & Associates, this is how we operate—and the consultation is always FREE. Call (404) 400-4000 to schedule your free consultation today.
