Possible Slip and Fall Hazards at Quiznos

Slip and fall accidents are some of the most common injury accidents that occur in Georgia. Slip and fall hazards are especially common at restaurants like Quiznos where things can spill, fall, or become broken and cause someone to slip and fall.

Slip and fall hazards or dangerous conditions that can happen at Quiznos include:

• Spilled food or beverage items
• Oil or grease on the floor
• Water or urine on bathroom floors
• Uneven or broken pavement
• Curled up or frayed rugs or carpeting
• Water at the entrances or exits
• Poor lighting
• Broken stairs or stairs without railings

Negligence is most important in a slip and fall claim. In other words, you’ll need to show that the restaurant was negligent in your accident. It’s not enough for a hazard to have been present and caused your fall. You’ll also need to demonstrate that Quiznos employees failed to recognize and clean up the hazard within a reasonable amount of time.

You’ll also need to show that you could not have avoided the slip and fall hazard simply through being careful. The restaurant or their insurance company might try to say that you should have been able to prevent your accident even with the hazard present. You’ll need to have a defense ready for this in your case.

The Slip and Fall Accident Case Process

When you contact a slip and fall accident lawyer to help with your Quiznos case in Georgia, they will follow certain procedures when working on your case. Every law firm works a little differently, but the case typically follows a basic process.

Documenting Everything

When you first contact the law firm and schedule a consultation, your lawyer will begin gathering information related to your claim. That includes:

• Medical bills
• Medical records
• Accident reports
• Insurance information
• Where, when, and how the accident happened
• And more

This will give your lawyer an idea of how your case looks and what to expect.

Investigating the Accident

Your lawyer will also investigate as many details as possible about your slip and fall accident. They will compile information about the Quiznos location, how the accident occurred, any witness accounts, and more. Your lawyer will also work to get additional information the shows what happened, such as any pictures of the scene and security camera footage.

Building Your Claim

When your lawyer has enough information to demonstrate what happened and the damages you suffered, they’ll help you build your personal injury claim to file with the restaurant’s insurance company. Your lawyer can also communicate and deal with the insurance company for you during the entire process.

Negotiating with the Insurance Company

Insurance companies rarely accept a victim’s request for compensation right away. It’s more likely that they’ll try to deny your claim or offer you an extremely low settlement. Your lawyer will then work to negotiate a settlement that is actually fair to you.

Most personal injury cases end during negotiation. However, if negotiation is not successful, you and your lawyer might begin preparing for trial.

You Have Two Years to File a Quiznos Slip and Fall Case in Georgia

In Georgia, according to Georgia Code § 9-3-33, the statute of limitations for personal injury cases is two years. That means you have two years from the date of your slip and fall accident to bring a legal case.

While two years might seem like a lot of time, it’s really not in a legal context. You will need to take several steps before filing your claim, including the time you need to heal from your injuries. It’s best to wait until you reach maximum medical improvement (MMI) so you will know the full extent of your medical costs, and reaching MMI can take a lot of time.

If you try to bring a case past the statute of limitations, it’s unlikely that you’ll be able to recover anything. So, it’s best to get started now by reaching out to a knowledgeable slip and fall lawyer in Georgia.
