What to Know About Cheesecake Factory and Slip and Fall Accidents in Georgia
The Cheesecake Factory began as a small shop in Detroit, Michigan, at the end of the 1950s before becoming a wholesale bakery in Los Angeles in 1972. From there, popularity grew until the first Cheesecake Factory was opened in the 1990s. In Georgia, Cheesecake Factory establishments can be found in Atlanta, Alpharetta, and Buford.
Besides cheesecakes, diners can order many different types of appetizers, burgers, chicken entrees, pasta dishes, seafood, steaks, and vegetarian options at the Cheesecake Factory. The restaurant has been criticized by different groups for its high-calorie menu options—but the food may not be the only health-related hazard.
If Cheesecake Factory managers and employees are not careful to maintain safe premises for customers, they may be liable for the costs of a slip and fall accident (Georgia Code section 51-3-1). It’s in your best interest to speak to a lawyer about your options if you were injured at a Cheesecake Factory location in Georgia.
How Slip and Fall Accidents Can Happen at Cheesecake Factory in Georgia
The great popularity of Cheesecake Factory restaurants means high foot traffic during peak meal times. When things are busy, it can be hard for employees to keep up with all safety standards. This puts customers at risk of exposure to injury hazards on the property.
Examples of hazards or dangerous conditions that can lead to slip and fall accidents at Cheesecake Factory include:
- Wet, slippery floors without any “wet floor” warnings
- Dropped food items
- Spilled water or other beverage items
- Torn or curled up rugs or carpeting
- Rain or melted ice or snow that has been tracked inside
- Lack of mats to prevent slippery surfaces
- Unexpected steps going up or down
- Broken stairs or missing railings
- Uneven flooring or pavement
- Urine or other liquids on bathroom floors
People don’t visit Cheesecake Factory expecting to leave with painful injuries, medical costs, and other losses. If you find yourself slipping and falling, the store may be responsible because they failed to exercise ordinary care.
You may be entitled to file a personal injury claim for compensation—but you will need to begin compiling proof of what happened.
Building a Cheesecake Factory Slip and Fall Accident Claim in Georgia
To have a valid injury claim, you’ll need to prove that:
- Cheesecake Factory employees owed you a duty of care.
- That duty of care was breached.
- Because the duty was breached, you suffered a slip and fall accident.
- Your slip and fall accident (caused by the store’s negligence) led to your damages.
These elements are often hard to prove on your own. Although you have every right to represent yourself in a personal injury claim, we don’t recommend it.
A slip and fall injury lawyer will know how to get started and what your legal options are—plus, most injury lawyers work on contingency. That means you don’t pay them a fee until after they win you money. (That’s how we operate at John Foy & Associates. Contact us at (404) 400-4000 today for a FREE consultation).

Dealing with the Insurance Company in Your Personal Injury Claim
When you file your personal injury claim for compensation from Cheesecake Factory, you’ll really be dealing with their insurance company. The business will have premises liability insurance that covers accidents that occur on their property. So, when you file a claim, the insurance company communicates with you rather than Cheesecake Factory.
Insurance companies do not like to pay out much (if anything at all) on injury claims. They will often look for ways to deny a victim’s claim or offer them a lowball settlement. Common tactics insurers use include:
- Calling you soon after the accident and asking how you’re doing, then using anything you say (even that you’re “fine” or “okay”) against you later
- Trying to intimidate you into accepting the first offer
- Downplaying the severity of your injuries
- Claiming you suffered some of your injuries before the accident
- Blaming you for some or all of the slip and fall accident
Insurers know that most injury victims aren’t experienced with insurance claims. They are hoping you’ll take their first offer because if you do, you’ll end your case. Once you accept a settlement, there’s no way to seek further compensation for that accident.
If you hire an experienced injury lawyer who works on slip and fall accidents at places like Cheesecake Factory, you’ll show the insurance company that you’re taking the claim seriously. They are much more likely to agree to a higher settlement when an injury victim has a strong legal representation.
