How Rideshare Coverage Can Affect Your Case’s Outcome
Liability in a rideshare accident depends on who caused the crash and what the rideshare driver was doing at the time. Unlike regular car accidents, these cases can involve multiple insurance policies and companies trying to avoid paying for your damages.
Generally, here’s how coverage works:
- If the rideshare driver caused the accident, the driver’s auto insurance or the rideshare company’s insurance may cover the damages, depending on whether they were logged in to and using the app.
- If another driver caused the accident, then the driver’s insurance should pay for injuries and damages.
- If the rideshare company is responsible, they may have to cover the losses. In rare cases, rideshare companies, especially if they hired a driver with a history of reckless driving. Under Ga. Code § 33-1-24 (b)(3), rideshare companies, such as Uber and Lyft, must provide a minimum of $1 million in coverage in case of an accident involving one of their drivers.
Rideshare Insurance Can Be Complicated—We’ll Handle It for You
Drivers have different insurance coverage depending on whether they were logged in, waiting for a ride, or transporting a passenger. This aspect of your case can make filing a claim complicated. However, you can leave that concern to us. Our rideshare injury attorneys serving Chamblee will determine who is responsible.
Insurance companies can attempt to reduce how much they pay out. In some cases, they may even attempt to not pay claims at all. We will advocate for your fair compensation.

Multiple Parties Can Be Responsible for a Rideshare Accident
Determining fault in a rideshare crash isn’t always straightforward. Multiple parties could be responsible, including:
- The rideshare driver: If they were distracted, speeding, or otherwise negligent, they may be liable.
- Another driver: If another road user caused the accident, their insurer should cover damages.
- The rideshare company: In certain cases, the company could be held accountable, especially if the driver was actively working at the time.
- A vehicle maker: If a defective car part contributed to the crash, the manufacturer could be responsible.
- A government entity: If poor road conditions or faulty traffic signals played a role, a government agency may be liable.

Steps to Take After an Auto Accident in Chamblee, GA
After a rideshare accident, what you do next can affect your ability to recover compensation. Because companies such as Uber and Lyft have complex insurance policies, protecting your rights is important.
Here’s what you should do:
- Call 911 for emergency help: Report the accident to the police and request medical assistance. A police report can be valuable for your insurance claim or injury clients.
- Collect visual evidence (photos and videos): Capture damage to all vehicles, your injuries, road signs, and any hazards that may have contributed to the crash.
- Exchange information: Get the rideshare driver’s name, contact details, and insurance info, along with details from other drivers and witnesses.
- Notify the company about the accident: Inform the rideshare company that you’ve been in an accident. You can use its app, but avoid giving a recorded statement without legal guidance. You can call us first, and we can handle talks from there.
- See a doctor ASAP: Some injuries, like whiplash or concussions, may not show symptoms right away. A medical exam creates a record of your injuries. It also makes it easier to connect them directly to the crash.
- Get legal help: Rideshare companies and insurers will try to minimize what they pay you. Our legal team will handle the claims process so you can focus on recovering.
