What Are My Legal Rights After a Cumming Rideshare Accident?

If you were hurt in a rideshare accident, you may be entitled to compensation from the company whose negligence caused your injuries. The first step is to contact an experienced personal injury lawyer to help you file a claim against the rideshare company in court. But to be eligible, you must prove that:

• The driver was negligent (i.e., they failed to do what a reasonable person would have done under similar circumstances)
• Your injuries resulted directly from the driver’s negligence
• You suffered damages as a result of the accident

What Should You Expect from a Cumming Rideshare Accident Lawyer?

If you or your loved one have been injured in a rideshare accident, you need to hire a professional rideshare accident attorney in Cumming right away. But how will this help with your case? Here’s a breakdown of how a qualified personal injury lawyer can help you:

Advise You on Your Legal Rights

A good lawyer will not just represent you but also advise you about your legal rights after a rideshare accident. We will explain what you can expect from the insurance companies involved in the accident. We will guide you through the process of filing a lawsuit, negotiating settlements, and preparing your case for trial.

Evaluate the Facts of Your Case

An experienced Cumming rideshare accident law firm will evaluate the facts of your case to determine whether there is sufficient evidence to support your claims. We will look at the details of the accident, the extent of your injuries, and the amount of money needed to cover your medical costs, lost wages, and other damages. We will then use this information to negotiate a settlement offer with the insurance companies involved in your accident.

Explain the Process of Filing a Suit Against the Rideshare Company

A good lawyer will explain the entire process of pursuing a lawsuit against the rideshare company. We will tell you which documents you must submit to the insurer to show that the rideshare company is liable for your injuries. We will also ensure that you follow up on every document submitted to the insurance company.

Negotiate a Fair Settlement

If the defendant’s insurer wishes to settle the case, your Cumming rideshare lawyer will work with them to reach a reasonable settlement figure. The lawyer will consider the severity of the injuries, the cost of future medical care, the value of time missed from work, and the likelihood of recovering additional damages in court. If the parties cannot come to terms, the lawyer will go to trial and present your case before a jury.

Prepare Your Case for Trial

Your rideshare accident lawyer in Cumming will gather all available evidence, including witness statements, photographs, medical records, and other documents. We will interview witnesses and prepare exhibits for presentation at trial. When it comes time to argue your case before a judge or mediator, your lawyer will review the facts of the case and highlight any weaknesses in the opposing party’s case.

File a Personal Injury Lawsuit

After reviewing your case thoroughly, an experienced Cumming rideshare accident lawyer will file a personal injury lawsuit against the negligent party. That means you will sue the rideshare company for compensatory damages such as medical bills, lost wages, pain and suffering, emotional distress, and other losses.

What Damages Can You Recover in a Cumming Rideshare Accident?

• Medical expenses – Medical bills incurred after the accident date should be included in calculating total damages. It is vital to keep track of these bills because they often continue to accrue interest even after the accident.
• Lost wages – If you were unable to work because of your injuries, you could recover money for the amount of income you would have earned had you been able to continue working.
• Pain and suffering – A Cumming rideshare accident can cause severe physical and psychological distress. Compensation for this kind of harm should reflect how much pain you have endured since the accident.
• Wrongful death damages – If you lose a loved one due to a Cumming rideshare crash, you may be entitled to receive compensation for the wrongful death. These include funeral costs, medical bills, and other financial hardships resulting from the loss.
• Other losses – Other types of losses that can be compensated include property damage, loss of consortium, and emotional distress.
