Who Is Responsible for a Penske Accident
Based out of Bloomfield Hills, Michigan, Penske Automotive Group, Inc. is both a transportation services company and an automotive and commercial truck retailer. As such, figuring out who is liable for your accident may be difficult. Parties who may be responsible for a Penske accident include:
- Penske employee
- Someone who rented a truck from Penske
- Third-party that leased a truck from Penske
- Truck driver
A Penske truck accident attorney in Augusta, GA can review the facts surrounding your case. They can help you identify the at-fault party. Your lawyer can also help you pursue damages in accordance with Georgia’s statute of limitations for personal injury claims.
How Much Time You Have to File a Claim
With most personal injury claims, there is a two-year statute of limitations. This means you may have up to two years from the date of your accident to ask for damages from a liable party. If you choose not to file a claim within this period, you may be solely responsible for your accident-related losses.
An Augusta Penske truck accident attorney can help you submit your claim before the window in which you are allowed to do so expires. They may evaluate your losses. Your lawyer may encourage you to ask for economic and non-economic damages.
You may request economic compensation for quantifiable losses, including your medical expenses. Also, you may seek non-economic compensation for subjective losses, such as emotional trauma. Your attorney can help you calculate your damages and build an argument designed to show a judge or jury that you deserve this amount.

Penske Truck Accident Cost
You want the best results out of your accident claim. To get them, you must determine exactly how much your case is worth, and this requires you to look at how your accident will affect you both now and in the future. There are many reasons why accident victims ask for damages, and these include:
- Car repairs or replacement
- Lost wages
- Medical bills
- Pain and suffering
A Penske truck accident lawyer in Augusta will consider your immediate and long-term losses. They can craft an argument that explains why you deserve the damages that you are requesting. In the best-case scenario, a judge or jury will award you 100% of the damages you want.
How Comparative Negligence Applies to a Personal Injury Case
Your attorney can explain what can happen if you are partially at fault for your truck accident. In this scenario, comparative negligence may impact your ability to secure full damages. If a judge or jury says you are more than 50% liable, you may be ineligible to get compensation.
For example, a judge or jury may find you are 10% at fault for your accident. If this occurs, the defendant in your case may be required to pay 90% of the damages you requested. This also means you will have to cover 10% of your accident-related losses out of your own pocket.
Now, consider what can happen if a judge or jury rules you are 51% liable. At this point, you are more liable for your truck accident than the defendant. Therefore, the defendant may not have to pay you anything.
Penske Truck Accident Case Settlement
You may be wondering how settlements get paid in injury cases. A Penske truck accident attorney in Augusta can discuss settlements with you. If the defendant in your case offers to settle, your lawyer can help you figure out what to do next.
A settlement proposal may come at any time leading up to your trial. You are not legally obligated to approve a settlement. If the defendant makes a fair and reasonable offer, you may accept it, get damages, and close your case.
You have the final say on whether to accept, decline, or counter a settlement proposal. If you are unsure about what to do with an offer, your lawyer can explain what may happen with any decision you make. You should not accept a settlement unless it gives you adequate compensation, and if it does not, you may want to continue with your litigation.
