Proving Fault for a Cement Mixer Accident
An Augusta cement mixer truck accident attorney will determine who is at fault and, therefore, liable for your losses. They must review all relevant evidence and how the truck driver, trucking company, and others contributed to your accident. When the truck driver is the sole responsible party, then the employer is 100% liable for the victim’s losses.
The premise of fault depends on proving negligence. To recover the compensation you need, you must show the cement mixer truck was the cause of the accident because they operated the truck in a negligent manner.
That means the driver operated the cement mixer truck in a way that differed from how a reasonable person would have driven it in a similar situation. Your attorney will bear the burden of proving that the truck driver had a duty of care to drive safely and reasonably. They must also prove the driver breached or failed in this duty in some way, and that your injuries and damages are a direct result of that failure.
