Types of Sexual Abuse Claims in Georgia
In Georgia, sexual abuse victims may pursue different types of claims, including criminal prosecution and civil litigation. These two types of cases are separate and distinct, but both may be used to seek justice for the victim.
Criminal Sexual Abuse Cases
Criminal prosecution in sexual abuse cases is initiated by the state of Georgia. If a person is charged with sexual abuse, the state will pursue criminal charges, and the victim is not required to pay for the legal costs associated with the prosecution.
While criminal prosecution is focused on punishing the abuser, it does not result in compensation for the victim. However, the criminal justice system plays an important role in holding offenders accountable for their actions and ensuring they do not pose a threat to others.
Civil Sexual Abuse Claims
A civil sexual abuse claim allows victims to seek monetary compensation for the physical, emotional, and psychological harm they have endured as a result of the abuse.
In civil cases, the burden of proof is lower than in criminal cases, requiring the victim to prove their case by a “preponderance of the evidence” rather than “beyond a reasonable doubt.”
Victims can file a civil lawsuit against the abuser and other entities that enabled the abuse or failed to protect the victim. Civil lawsuits can also serve as a powerful tool for raising awareness about sexual abuse and sending a message that such behavior will not be tolerated.
Important Considerations in Sexual Abuse Cases
Several factors can complicate a sexual abuse case. Though your sexual abuse attorney in Athens will help you understand various nuances specific to your situation, it can be helpful to have a general understanding of what it takes to file a claim.
The Role of Evidence
Evidence plays a major role in both criminal and civil cases. In a criminal case, physical evidence—such as DNA or other forensic evidence—can help support you and add credibility to your allegations.
Meanwhile, in civil cases, evidence such as photographs, medical records, testimony from witnesses, and records of prior similar incidents can be used to build an even stronger case.
However, sexual abuse cases can often be complicated by the lack of physical evidence, especially in cases where the abuse occurred years ago.
The Emotional and Psychological Impact of the Abuse
Sexual abuse can have a profound emotional and psychological impact on victims. Many survivors experience feelings of guilt, shame, and confusion, all of which can make it that much more difficult to come forward and seek justice.
Additionally, the emotional trauma caused by sexual abuse can persist long after the physical wounds have healed. Therapy and counseling are often important for survivors who want to begin healing.
Even better, if you receive these services, documentation of your time spent attending therapy sessions or receiving counseling can provide valuable proof of the effects the abuse has had on your life.
The Presence of Multiple Defendants
In some cases, sexual abuse may involve multiple defendants. For instance, if the abuse occurred in a school or workplace, the institution could be held responsible for failing to take adequate steps to protect the victim or investigate the abuse soon enough.
In these situations, the victim may be able to file a lawsuit against both the abuser and the organization alike.
Confidentiality and Privacy
Given the sensitive nature of sexual abuse cases, confidentiality and privacy are often a concern for victims. Georgia’s laws provide mechanisms to protect the identity of victims in certain circumstances, especially during the criminal prosecution process.
In civil cases, victims may request that their identities remain confidential. They might even take other steps to further safeguard their privacy.
Recoverable Damages in a Sexual Abuse Case
Survivors of sexual abuse often suffer not only physically and emotionally but financially as well. At John Foy & Associates, we believe you deserve to recover a full and fair amount of compensation after everything you’ve endured.
When pursuing a civil claim for sexual abuse, three main categories of damages may be recoverable:
Economic Damages
These are tangible, out-of-pocket costs that resulted from the abuse you endured.
- Medical expenses: This is designed to compensate you for emergency care, hospital bills, surgical procedures, and follow-up medical treatment related to the abuse.
- Mental health treatment: You can seek compensation for therapy, counseling, medication, and other forms of psychological care that help survivors process trauma and begin healing.
- Lost wages: If the abuse caused you to miss work or permanently impacted your ability to earn a living, compensation for lost wages might be an option.
- Future medical and counseling costs: Long-term treatment may be necessary, and we can account for that in your claim.
Non-Economic Damages
These damages reflect the emotional and psychological toll the abuse has taken on you.
- Pain and suffering: This is intended to compensate you for the physical pain, emotional anguish, and lasting trauma caused by the abuse.
- Loss of enjoyment of life: If the abuse affected your ability to engage in daily activities, interpersonal relationships, or everyday life like you once enjoyed, you can seek what is known as loss of enjoyment of life compensation.
- Emotional distress: This is intended to serve as compensation for the anxiety, depression, PTSD, and other psychological effects associated with sexual abuse.
Punitive Damages
In particularly egregious cases, punitive damages may be awarded. These are designed to punish the abuser—as well as negligent parties who enabled or ignored the abuse—and send a clear message that this kind of behavior is not tolerated.
